3 cases of motor vehicles eligible for exemption from inspection on the inspection line; answers to questions about update of chip-based citizen ID cards of legal representatives of enterprises; etc., are notable documents that will be covered in this bulletin.

1. New regulation of Vietnam on 3 cases of motor vehicles eligible for exemption from inspection on inspection line

On March 21, 2023, the Minister of Transport of Vietnam promulgated Circular No. 2/2023/TT-BGTVT on amendments to Circular No. 16/2021/TT-BGTVT on technical safety inspection and environmental protection of road motor vehicles.

According to the Circular, 3 cases of motor vehicles eligible for exemption from inspection on the inspection line are as follows:

- Unused motor vehicles falling under cases of exemption from first-time inspection according to Clause 3 Article 5 of Circular No. 16/2021/TT-BGTVT (amended by Circular No. 2/2023/TT-BGTVT);

- Oversize motor vehicles unable to enter the inspection line: the inspection of operation and brake effectiveness or other work items that is impossible on the inspection line (if any) shall be performed on test roads outside of the inspection line or performed outside of the inspection authority according to Clause 3 Article 8 of Circular No. 16/2021/TT-BGTVT;

- Motor vehicles unable to move to the inspection authority for inspection that are permitted to be inspected outside of the inspection authority according to Clause 3 Article 8 of Circular No. 16/2021/TT-BGTVT:

+ Motor vehicles with records of factory release quality inspection for motor vehicles manufactured and assembled domestically or certificates (or notifications of inspection exemption) of technical safety and environmental protection for imported motor vehicles prescribing “non-road traffic motor vehicles”;

+ Motor vehicles operating in islands without inspection authorities;

+ Motor vehicles operating in areas secured in terms of safety, security, and national defense;

+ Motor vehicles operating in restricted areas such as ports, mines, and construction sites;

+ Motor vehicles performing urgent tasks (prevention, control, and management of natural disasters or epidemics).

Circular No. 2/2023/TT-BGTVT comes into force as of March 22, 2023.

2. New regulations of Vietnam on forms of payment for registration fees for motor vehicles and motorcycles

This is the content of Official Dispatch No. 691/TCT-DNNCN dated March 13, 2023 on the official implementation of the e-tax service system for declaring registration fees for motor vehicles and motorcycles promulgated by the General Department of Taxation of Vietnam.

Specifically, registration fees for motor vehicles and motorcycles may be paid via:

- Internet banking or mobile banking services of banks (Vietcombank, Vietinbank, BIDV, Agribank, MBBank, VPBank, TPBank, LienvietPostBank);

- The National Public Service Portal;

- The eTax Mobile application.

3. Answers to questions about update of chip-based citizen ID cards of legal representatives of enterprises in Vietnam

On March 21, 2023, the Business Registration Management Agency promulgated Official Dispatch No. 43/DKKD-GS on update of information on chip-based citizen ID cards of legal representatives.

According to the Official Dispatch, the Business Registration Management Agency receives feedback from several business registration agencies and enterprises on receiving the following notification from tax agencies:

By March 31, 2023, enterprises shall complete procedures for updating information on chip-based citizen ID cards for legal representatives on Certificates of Enterprise Registration. Enterprises shall be fined for failure to complete the procedures by this deadline.

Regarding this issue, the Business Registration Management Agency has consulted with the General Department of Taxation of Vietnam, affirming that no guidelines, emails, or notifications about the above content are sent to taxpayers.

Registration and notification of changes to enterprise registration contents have been prescribed by the Law on Enterprises and Decree No. 01/2021/ND-CP.

4. Vietnam to provide guidelines on forms of organizing meeting sessions of National Assembly of Vietnam

The Standing Committee of the National Assembly of Vietnam approved Resolution No. 31/2023/UBTVQH15 stipulating and guiding several terms of the Internal Regulation on meeting sessions of the National Assembly of Vietnam.

According to the Resolution, guidelines on forms of organizing meeting sessions of the National Assembly of Vietnam are as follows:

- Direct meeting: performed with the direct participation of every delegate of the National Assembly of Vietnam at a location.

- Online meeting: performed via the video conferencing system between the main bridge point in Hanoi and bridge points in other provinces and centrally affiliated cities. The Standing Committee of the National Assembly of Vietnam shall decide on the number of bridge points, provinces and centrally affiliated cities that have bridge points, locations of bridge points, and Delegations of the National Assembly of Vietnam participating in meeting sessions at each bridge point.

The General Secretary of the National Assembly of Vietnam - Head of the Office of the National Assembly of Vietnam shall, based on the actual situation, consult with the Standing Committee of the National Assembly of Vietnam on decisions on the organization of online meetings via other methods.  

- Direct meeting combined with online meeting: performed in cases of meeting periods with meeting sessions organized directly and meeting sessions organized via online methods.
