Guidelines for adjustments to pensions and social insurance allowances from July 1, 2023; 8 cases of revocation of certificates of registration and license plates for motor vehicles, etc., are notable contents that will be covered in this bulletin.

New regulation of Vietnam on 8 cases of revocation of certificates of registration and license plates for motor vehicles

On July 1, 2023, the Minister of Public Security of Vietnam promulgated Circular No. 24/2023/TT-BCA on issuing and revoking the registration and license plates for motor vehicles. , which contains 8 cases of revocation of certificates of registration and license plates for motor vehicles.

According to the Circular, the mentioned 8 cases are as follows:

- Motor vehicles are damaged, unusable, or destroyed due to objective reasons.

- Motor vehicles are at the end of their life cycle and banned from circulation as prescribed by laws.

- Motor vehicles that are stolen, appropriated, discarded, or have their certificates of registration and license plates revoked at the requests of their owners.

- Imported motor vehicles exempted from tax or motor vehicles of foreign agencies, organizations, or individuals temporarily imported for re-export, ownership transfer, or destruction.

- Motor vehicles registered at economic zones under regulations of the Government of Vietnam after re-export or transfer to Vietnam.

- Motor vehicles involved in procedures for ownership transfer or transfer.

- Motor vehicles with removed engines or chassis for the registration of other motor vehicles.

- Registered motor vehicles with detected forged documentation or motor vehicles concluded by competent agencies to have their vehicle registration numbers or chassis numbers cut, welded, chiseled, or erased or improper license plate issuance.

Circular No. 24/2023/TT-BCA of the Ministry of Public Security of Vietnam comes into force as of August 15, 2023.

Vietnam’s guidelines for adjustments to pensions and social insurance allowances from July 1, 2023

On June 29, 2023, the Minister of Labor - War Invalids and Social Affairs of Vietnam promulgated Circular No. 06/2023/TT-BLDTBXH guiding the adjustments to pensions, social insurance allowances, and monthly allowances:

 (1) From July 1, 2023, pensions, social insurance allowances, and monthly allowances of persons prescribed in Clause 1 Article 1 of Circular No. 06/2023/TT-BLDTBXH are adjusted as follows:

- + Increased by 12,5% compared to the amount of June 2023 (adjusted in Decree No. 108/2021/ND-CP) for persons prescribed in Clause 1 Article 1 of Circular No. 06/2023/TT-BLDTBXH, specifically:

Pensions, social insurance allowances, and monthly allowances from July 2023 = the amount of June 2023 x 1,125

- + Increased by 20,8% compared to the amount of June 2023 (not adjusted in Decree No. 108/2021/ND-CP) for persons prescribed in Clause 1 Article 1 of Circular No. 06/2023/TT-BLDTBXH, specifically:

Pensions, social insurance allowances, and monthly allowances from July 2023 = the amount of June 2023 x 1,208

 (2) From July 1, 2023, pensions, social insurance allowances, and monthly allowances for persons prescribed in Clause 2 Article 1 of Circular No. 06/2023/TT-BLDTBXH after adjustments according to Point (1) are as follows:

- For persons who receive pensions, social insurance allowances, and monthly allowances below 2.700.000 VND per month:

Pensions, social allowances, and monthly allowances after adjustments = the amount adjusted under Clause 1 Article 2 of Circular No. 06/2023/TT-BLDTBXH + 300.000 VND per month

- For persons who receive pensions, social insurance allowances, and monthly allowances from 2.700.000 VND per month to below 3.000.000 VND per month:  

Pensions, social insurance allowances, and monthly allowances after adjustments = 3.000.000 VND per month

Circular No. 06/2023/TT-BLDTBXH of the Ministry of Labor - War Invalids and Social Affairs of Vietnam comes into force as of August 14, 2023.

New regulation of Vietnam on proposal forms and time limit for settlement of proposals in state audit activities

On July 5, 2023, the Auditor General of the State Audit Office of Vietnam promulgated Decision No. 10/2023/QD-KTNN on regulations on complaints, proposals, and lawsuits in state audit activities.

According to the Decision, regulations on proposal forms and time limit for settlement of proposals in state audit activities are as follows:

 (1) Proposal forms

- Proposals must be in writing, such as proposal applications; written explanations or requests for reconsideration of audit results, decisions on fines, and audit acts; proposals in reports on the implementation of audit conclusions and proposals.

- A written proposal must contain:

+ Date.

+ Name and address of the petitioner.

+ Proposal contents.

+ Reasons.

+ Signature and seal (if any) of the petitioner.

+ Other documentation (if any).

 (2) Settlement time limit:  

The settlement shall be within 30 days or 45 days in complicated cases after receiving the written proposal.

New regulation of Vietnam on conditions for using Public Property Management Software

On July 12, 2023, the Minister of Vietnam promulgated Circular No. 48/2023/TT-BTC guiding the management, use, and utilization of the Public Property Management Software.

According to the Circular, regulations on conditions for using Public Property Management Software are as follows:

- Computers must be connected to the Internet, updated with operational system patches for security; installed with antivirus software, and regularly updated with versions that can identify new virus forms.

- Information that is inputted into the Software must be in Unicode TCVN 6909:2001 for Vietnamese writing. Documents written in fonts other than Unicode TCVN 6909:2001 must be converted to it before being uploaded to the Software.  

- Each data entry unit prescribed in Point a Clause 1 Article 8 of Circular No. 48/2023/TT-BTC is provided with an account (including username and password) and granted management and use rights for access to the Software by the Ministry of Finance of Vietnam (via the Department of Public Asset Management).

- Each data entry unit prescribed in Points b and c Clause 1 Article 8 of Circular No. 48/2023/TT-BTC is provided with an account (including username and password) and granted use rights for access to the Software by a manager. This account shall be approved by the Ministry of Finance of Vietnam (via the Department of Public Asset Management).

- Computers are recommended to meet the following conditions for ensuring access to the Software:

+ Computer configuration: at least 2-core processor, 2 GHz; at least 8GB of RAM.

+ Browser: at least Mozilla Firefox 100+, Google Chrome 100+, or Safari 13+.

+ Operational System: at least Windows 10 or equivalences.

Circular No. 48/2023/TT-BTC of the Ministry of Finance of Vietnam comes into force as of August 27, 2023.
