Striving to achieve a digital economy proportion in GDP of about 15,5%; The list of job positions of professional titles in public service providers in the banking sector; etc., are notable contents that will be covered in this bulletin.

1. Vietnam to strive to achieve a digital economy proportion in GDP of about 15,5%

This content is prescribed in Resolution No. 01/NQ-CP on major tasks and solutions to the implementation of the Socio-Economic Development Plan, State Budget Estimates, improvement of the business environment, and enhancement of the national competitiveness 2023 promulgated by the Government of Vietnam on January 6, 2023.

According to the Resolution, the production and service sectors in association with creativity shall continue to be restructured and science and technology applications shall be increased:

To strongly develop in-depth industrial production and promote the structural transformation to increase the proportion in the processing and manufacturing sectors.

To accelerate the restructuring process of industrial sectors in association with the implementation of digital transformation and deepen participation in the global value chain.

To strive to achieve a digital economy proportion in GDP of about 15,5%.

To focus on solving difficulties and providing support for enterprises to recover their business production, put major industrial projects with important roles into operation to increase the production capacity; extend and diversify the import and export market.  

To synchronously implement measures to stabilize production, ensuring the supply of basic and essential goods such as petroleum, electricity, coal, fertilizers, etc.

2. New regulation of Vietnam on the list of job positions of professional titles in public service providers in the banking sector

On December 30, 2022, the Governor of the State Bank of Vietnam promulgated Circular No. 21/2022/TT-NHNN on guidelines for job positions of leaders, managers, and professional titles in public service providers in the banking sector.

According to the Circular, the list of job positions of professional titles in public service providers in the banking sector prescribed in Appendix III promulgated together with Circular No. 21/2022/TT-NHNN includes:

- Job position of Credit Information grade II;

- Job position of Credit Information grade III.

A job description and a qualification frame of job positions of professional titles in public service providers in the banking sector as prescribed in Appendix IV promulgated together with Circular No. 21/2022/TT-NHNN.

3. Vietnam to promulgate the Charter of pedagogical colleges

On December 30, 2022, the Minister of Education and Training of Vietnam promulgated Circular No. 23/2022/TT-BGDDT on the Charter of pedagogical colleges.

According to the Circular, the Charter of pedagogical colleges stipulates the goals and missions; tasks and entitlements of pedagogical colleges; organization and management of pedagogical colleges; organization of training activities; tasks and entitlements of lecturers, managers, and learners; finance and property of pedagogical colleges; relations between pedagogical colleges with families of learners and society.

**Regarding a currently operating pedagogical college that has not implemented laws on the establishment of school councils (not having a school council), within 6 months after February 14, 2023, the school leadership collective shall direct the establishment of the school council following Article 9 of this Charter.  

**Regarding a pedagogical college that has a school council: if the school council’s working term is less than 6 months by February 14, 2023, the school council shall operate until the end of its working term while the leadership collective directing the implementation of the process of establishing a school council for the next working term following Article 9 of this Charter.  

If the working term of the school council is more than 6 months by February 14, 2023, perform as follows:

- If the school council has been established in compliance with this Charter, the school council shall operate until the end of its working term and perform tasks, entitlements, and responsibilities following the law and regulation on the organization and operation of the school;

- If the school council has been established contrary to this Charter, within 6 months as of February 14, 2023, the leadership collective shall direct the review, amendment, and replacement to complete the school council, ensuring compliance with Article 8 and Article 9 of this Charter. The school council shall operate until the end of its working term and perform tasks, entitlements, and responsibilities following the law and regulations on the organization and operation of the school.

Circular No. 23/2022/TT-BGDDT comes into force as of February 14, 2023, and replaces Circular No. 01/2015/TT-BGDDT.

4. New regulation of Vietnam on the principle of the organization of benefits in kind for employees engaging in dangerous work

This content is prescribed in Circular No. 24/2022/TT-BLDTBXH dated November 30, 2022 on the provision of benefits in kind for employees in harmful and dangerous environments promulgated by the Minister of Labor - War Invalids and Social Affairs of Vietnam.

According to the Circular, the principle of the organization of benefits in kind is as follows:

- The organization of benefits in kind shall be performed within a working shift or a working day, ensuring convenience, safety, and food hygiene.  

If employees engage in itinerant, scattered work, work with few people, or other work that have unstable labor organization leading to unavailability of the organization of concentrated on-site training, employers shall provide benefits in kind for their employees to train themselves according to regulations.

In this case:

- Employers shall prepare an allocation list with the signatures of their employees and regularly inspect the training of employees.

- Employers shall not pay cash or include benefits in the salary (including the inclusion into the salary unit price) as a replacement for benefits in kind.

- Employers are encouraged to consider and decide on the provision of benefits in kind at level 1 (13.000 VND, currently, it is 10.000VND) for employees not engaging in jobs or work included in the list of jobs and work that are particularly arduous, hazardous, and dangerous and arduous, hazardous, and dangerous stipulated by the Minister of Labor - War Invalids and Social Affairs of Vietnam but are currently working in a labor environment that has at least one of the dangerous or hazardous factors as prescribed in Clause 2 Article 3 of Circular No. 24/2022/TT-BLDTBXH.

- The cost of benefits in kind shall be recorded into the regular operation cost and business production cost as prescribed by law.

Circular No. 24/2022/TT-BLDTBXH comes into force as of March 1, 2023 and replaces Circular No. 25/2013/TT-BLDTBXH.
