Urgent issuance of land price list and documents guiding implementation of Law on Land 2024; principles of developing index for Departments of Education and Training and Divisions of Education and Training; etc., are notable documents that will be covered in this bulletin.

1. Vietnam to urgently issue adequate land price list and documents guiding implementation of Law on Land 2024 

On November 30, 2024, the Prime Minister of Vietnam promulgated Official Telegram No. 124/CD-TTg urging the collection of state budget revenues regarding revenues concerning land in the last months of 2024.

According to the Official Telegram, to contribute to the completion of tasks of collecting state budget revenues at the highest level and create momentum for the successful implementation of tasks of socio-economic development in 2025 and during 2026-2030, the Prime Minister of Vietnam requests Presidents of People’s Committees of provinces and centrally affiliated cities to: 

- Accelerate the formulation of master planning and detailed planning as the grounds to implement real estate projects in an effective, conformable, consistent, and modern manner. 

- Urgently issue the adequate land price list and other contents specified in the Law on Land 2024 and the guiding documents; direct the Departments of Natural Resources and Environment, Departments of Finance, and Departments of Constructions to cooperate with relevant departments and authorities in successfully implementing compensations and resettlement support; focus on appraising and determining land prices; accelerate the auctions of land use rights and land lease rights for eligible projects for tax authorities to have grounds to urge the timely transfer of revenues concerning land in their areas to the state budget.

- Actively direct, review, and determine the number of outstanding land-related applications, reasons, and solutions and specify the responsibilities of relevant organizations and individuals; review real estate projects implemented in their areas with difficulties concerning procedures for investment, construction, planning, compensation, site clearance, etc., to promptly resolve such difficulties and submit reports to competent authorities for consideration regarding content exceeding their jurisdiction. 

- Drastically direct departments and authorities to review and carry out the revocation procedure for projects with land allocation decisions and no difficulties, yet investors do not implement or implement such projects behind schedule and fail to fulfill the financial obligations according to the law on land and select other investors with adequate capacity to carry out the implementation, preventing waste.  

- Intensify the monitoring and supervision of the local real estate markets to promptly adopt appropriate measures to stabilize the situation and maintain safe, healthy, and sustainable market development. 

- Continue to maintain and intensify the operations of the Steering Committee for Revenue Loss Prevention and Tax Debt Collection, direct local authorities to cooperate with tax authorities in the collection and prevention of budget revenue loss and collection of debts regarding revenues from land, utilize the increased revenues for the state budget, and strive for the completion of tasks of state budget revenue collection at the highest level.

2. Principles of developing index for Departments of Education and Training and Divisions of Education and Training in Vietnam 

On November 29, 2024, the Minister of Education and Training of Vietnam promulgated Decision No. 3806/QD-BGDDT 2024 on the digital transformation assessment index for the Departments of Education and Training and Divisions of Education and Training. 

Specifically, the principles of developing the index for the Departments of Education and Training and Divisions of Education and Training are as follows: 

- Following the requirements of the National Digital Transformation Program, the Scheme for intensification of the application of information technology and digital transformation to education and training during 2022-2025, with an orientation toward 2030, and regulations relevant to digital transformation of the Ministry of Education and Training of Vietnam. 

- Being able to assess the directive, management, organization, and guidance on the implementation of digital transformation of local education management authorities. 

- Ensuring the scientific nature and conformity with actual local conditions and substantive, objective, transparent, fair, and feasible assessment in the application. 

- Ensuring that the digital transformation results of educational institutions under management are part of digital transformation assessments of education management authorities. 

- Ensuring the openness of the index and updates conform to actual situations.

3. 3 principles applied in pilot handling of material evidence during investigations of criminal cases in Vietnam from January 1, 2025 

On November 28, 2024, the National Assembly of Vietnam promulgated Resolution No. 164/2024/QH15 on the pilot handling of material evidence and property during the investigation, prosecution, and trial of criminal cases. 

Principles applied in the pilot handling of material evidence during investigations of criminal cases prescribed in Article 2 of Resolution No. 164/2024/QH15 include: 

- Respect, protection, and assurance of human rights and citizen rights; assurance of basic principles of criminal, civil matters, criminal procedure, civil procedure, and civil judgment enforcement laws. 

- Compliance with actual requirements and timely and effective handling of material and property without affecting the proof and settlement of cases; early remedy for consequences and damage, putting property into utilization and use to unlock development resources and avoid loss and waste; assurance of the benefits of the State and legitimate rights and benefits of organizations and individuals; conformity with international treaties to which the Socialist Republic of Vietnam is a signatory. 

- Assurance of the control of power among civil proceeding authorities and supervision of competent organizations and organizations regarding procedural activities under the law; assurance of the responsibility for exercising prosecutorial power and supervising law compliance of Procuracies during the handling of material evidence and property; strict handling of acts of violations, abuse, corruption, and negativity incurred during the application of measures to handle material evidence and property. 

- Assurance of complaint and denunciation rights and rights to receive compensation from the State according to the criminal procedure and State’s compensation responsibility laws and relevant laws.

4. Vietnam’s request for intensification of inspection of compliance with thrift practice and waste prevention laws 

On December 1, 2024, the Prime Minister of Vietnam promulgated Official Telegram No. 125/CD-TTg 2024 on promoting thrift practice and waste prevention. 

According to the Official Telegram, to continue to intensify the effective and efficient implementation of thrift practice and waste prevention policies and laws, the Prime Minister of Vietnam requests the Ministry of Finance of Vietnam to take charge and cooperate with ministries, ministerial agencies, governmental agencies, and People’s Committees of provinces and centrally affiliated cities in: 

- Completing laws relevant to thrift practice and waste prevention and proposing amendments to the Law on Thrift Practice and Waste Prevention 2013

- Summarizing and submitting reports on the results of the re-review of public property and working headquarters that fail to use or ineffectively use public property to the Prime Minister of Vietnam and proposing handling schemes as per regulation, preventing waste and loss of property of the State.  

- Intensifying the inspection of compliance with thrift practice and waste prevention laws.
