In the past week (from February 7, 2022 – February 12, 2022), the Law Clerk has updated a number of outstanding documents as follows:

1. Temporarily suspending import and re-export of medical masks and gloves

The Ministry of Industry and Trade has just issued  Circular 03/2022/TT-BCT  stipulating the temporary suspension of business of temporary import for re-export of medical masks, medical gloves and epidemic prevention and control costumes.

Accordingly, temporarily suspending the business of temporarily importing and re-exporting medical masks, medical gloves and epidemic prevention and control outfits (including clothes, glasses, medical masks, protective hats, gloves, etc.) shoes) in the List in the Appendix issued with  Circular 03/2022/TT-BCT .

For shipments of medical masks, medical gloves and anti-epidemic uniforms that have gone through customs procedures for temporary import from January 1, 2022 to before March 15, 2022, they can continue to carry out customs procedures for temporary import. currently re-exported according to the provisions of  Decree 69/2018/ND-CP .

This regulation applies to traders engaged in the business of temporary import for re-export of goods; organizations and agencies managing temporary import for re-export; agencies, organizations and individuals involved in the business of temporary import for re-export of goods.

Circular 03/2022/TT-BCT  takes effect from March 15, 2022 to December 31, 2022.

2. Advertising texting after 10pm without agreement is fined up to 30 million VND

 Decree 14/2022/ND-CP  amending and supplementing a number of regulations on sanctioning of administrative violations in the fields of post, telecommunications, radio frequencies, information technology and electronic transactions.

Accordingly, at point c, clause 32, Article 1 of Decree 14/2022/ND-CP , some acts of applying a fine ranging from VND 20 million to VND 30 million include:

- Making more than 01 advertising call to 01 phone number within 24 hours without other agreement with the user;

- Send advertising messages outside the period from 07h - 22h every day or call advertising from 8am - 5pm every day without agreement with the user.

- There is no measure to check the user's prior consent clearly when sending advertising messages, promotional emails, advertising phone calls;

- Do not provide users with a tool to look up or store agreements on registration, rejection of advertising calls, messages to register for advertising on their Portals/Websites, social networks. to serve the inspection, examination and settlement of complaints and denunciations;

- Failing to instruct service users on how to combat spam messages, spam calls, and spam emails.

Decree 14/2022/ND-CP takes effect from January 27, 2022.

3. Increased fines for some violations of electricity use

The Government promulgates   Decree 17/2022/ND-CP  amending Decrees on sanctioning of administrative violations in the field of chemicals and industrial explosives; electricity, safety of hydroelectric dams, economical and efficient use of energy; commercial activities, production and trading of counterfeit goods, ...

Accordingly, increasing fines for a number of violations of regulations on electricity use, for example:

- A fine ranging from VND 2-3 million shall be imposed for obstructing the competent person to inspect the use of electricity.

(Previously, the regulation imposed fines from 500,000 VND to 1 million VND).

- A fine of between VND 3-5 million for one of the following violations:

+ Unintentionally causing breakdown in the electricity system of the electricity seller;

Arbitrarily supplying electricity to other organizations and individuals.

(Previously fined from 1-2 million VND)

- A fine of between VND 5-8 million for acts of arbitrarily installing, closing, cutting, repairing, moving, replacing electrical equipment and electrical works of the electricity seller.

(Previously fined from 2-4 million VND)

Decree 17/2022/ND-CP  takes effect from January 31, 2022.

4. 02 cases of stopping toll collection at road user toll stations

The Ministry of Transport has issued  Circular 45/2021/TT-BGTVT  regulating the operation of road toll stations.

Accordingly, there are 02 cases where toll stations are stopped, including:

- In case the project expires, payback according to the contract.

The collection management unit must actively stop the collection or comply with the decision to stop the collection of the competent agency (or the unit assigned to manage the collection of road user service charges).

The determination of collection stopping time is determined according to the collection contract of the competent authority with the collection management unit or the contract with the PPP project enterprise.

- Stop toll collection in cases of termination of PPP project contracts before the deadline specified in Clause 2, Article 52 of the Law on Investment under the mode of public-private partnership. (New content added)

Circular 45/2021/TT-BGTVT  takes effect from March 31, 2022.
