In the past week (from December 20 to December 25, 2021), the Law Clerk has updated a number of outstanding documents as follows:

1. Import tariff quotas for salt and poultry eggs in 2022

The Ministry of Industry and Trade has issued  Circular 24/2021/TT-BCT  stipulating the principles of import management under tariff quotas for salt, poultry eggs and raw tobacco in 2022.

Accordingly, the quantity of imports under tariff quotas for salt, poultry eggs and raw tobacco in 2022 is regulated as follows:

- For chicken eggs (goods codes are 0407.21.00 and 0407.90.10); duck and geese eggs (commodity codes are 0407.29.10 and 0407.90.20); others (codes are 0407.29.90 and 0407.90.90):  63,860 dozen .

- For salt (commodity code 2501):  80,000 tons  (Number of temporary distribution for the first phase in 2022).

- For raw tobacco (commodity code is 2401):  65,156 tons .

Regarding the subjects of assignment of import tariff quotas:

- Tariff quotas on salt imports are assigned to traders directly for use as raw materials for chemical production and as raw materials for the production of drugs and medical products.

- Import tariff quotas for poultry eggs shall be assigned to traders wishing to import.

- Tariff quotas for import of raw tobacco shall be assigned to traders who have a license to produce tobacco issued by the Ministry of Industry and Trade and have a need to use raw tobacco for cigarette production.

Circular 24/2021/TT-BCT  takes effect from February 1, 2022 to the end of December 31, 2022.

2. Hospitals and clinics must prescribe e-drugs before December 1, 2022

This is a notable content in  Circular 27/2021/TT-BYT  regulating drug prescribing in the electronic form.

Accordingly, medical examination and treatment establishments must make prescriptions in electronic form as prescribed in  Circular 27/2021/TT-BYT  according to the specific schedule as follows:

- For hospitals of grade 3 or higher: to be completed before June 30, 2022.

- For other medical examination and treatment facilities: to be completed before December 1, 2022.

Regarding the content and electronic prescribing:

- In case of prescription of pharmaceutical chemicals, biological products in outpatient treatment: Comply with the provisions of Circular  52/2017/TT-BYT  and Circular  18/2018/TT-BYT .

- In case of prescription of traditional drugs, herbal drugs and prescription of combination of traditional drugs, herbal drugs with pharmaceutical drugs (for outpatients): Follow the provisions of Circular  44/2018/TT -BYT .

- In case of prescription in the notes section of the discharge paper (for inpatients discharged from the hospital): Follow the provisions in Appendix 3 of Circular  56/2017/TT-BYT .

Circular 27/2021/TT-BYT  takes effect from February 15, 2022.

3. How to handle money directly related to the crime of high interest lending

The Judicial Council of the Supreme People's Court has issued  Resolution 01/2021/NQ-HDTP  guiding the application of Article 201 of  the Penal Code  and the trial of criminal cases on the crime of lending money with high interest in civil transactions.

Accordingly, instructions on objects and money directly related to the crime of usury in civil transactions shall be handled as follows:

- Confiscation of state funds for:

+ Amounts of money and properties other than those used by the offender to lend;

+ The interest corresponding to the highest interest rate according to the provisions of the Civil Code that the offender has collected from the borrower.

+ Money and other properties that the offender has gained from the use of profits and other illegal revenues.

- Return to the borrower the illicit profits that the offender actually collected.

In case the borrower uses the loan money for illegal purposes (such as gambling, illegal drug trading, fraudulent appropriation of property, ...) government.

Resolution 01/2021/NQ-HDTP  takes effect from December 24, 2021.

4. Additional job title Heritage member class I, salary up to more than 11 million

This is the content of Circular 16/2021/TT-BVHTTDL  stipulating codes, standards for professional titles and salary classification of cultural heritage officials.

Accordingly, the regulations on professional titles of cultural heritage officers include:

- Class I heritage member (Code: V.10.05.29);

- Class II heritage member (Code: V.10.05.16);

- Class III heritage member (Code: V.10.05.17);

- Class IV heritage member (Code: V.10.05.18).

(Compared with current regulations,  Circular 16/2021/TT-BVHTTDL  has added the professional title of class I heritage officer).

In addition,  Circular 16/2021  also stipulates the standards for training, retraining and professional competence for the title of Class I heritage member as follows:

- Possessing a master's degree or higher relevant to the field of cultural heritage;

- Possess a certificate of standardization of professional titles and professional titles of cultural heritage officers.

- Having in-depth knowledge on the protection and promotion of cultural heritage values;

- Having basic information technology skills, using foreign languages ​​or using ethnic minority languages ​​for officials working in ethnic minority areas according to job position requirements,...

Circular 16/2021/TT-BVHTTDL  takes effect from February 5, 2022.
