Solutions for reducing late payment of social insurance, health insurance and unemployment insurance premiums in the last months of 2022, 06 Laws adopted in the 4th plenary session of the 15th National Assembly, etc. are contents to be included in the last week's documents (from November 21 to November 27, 2022).

1. 06 Laws adopted in the 4th plenary session of the 15th Vietnamese National Assembly

Resolution No. 76/2022/QH15 dated November 15, 2022 on the 4th plenary session of the 15th National Assembly is adopted by the Vietnamese National Assembly;

According to the Resolution, 06 Laws adopted in the 4th plenary session of the 15th National Assembly include:

- Law on Petroleum.

- Law on Prevention and Control of Domestic Violence;

- Law on Prevention and Control of Money Laundering;

- Law on Inspection;

- Law on Implementing Grassroots Democracy;

- Law on amendments to certain Articles of the Law on Radio Frequencies.

In addition, at the session, some Resolutions are also adopted, such as:

- Resolution promulgating Rules for the National Assembly’s session;

- Resolution on the Socio-Economic Development Plan in 2023;

- Resolution on state budget estimates in 2023;

- Resolution on central budget allocation in 2023;

- Resolution on speeding up the implementation of policies and laws on thrift practice and waste combat;

- Resolution on pilot auction of license plates for cars;

- Resolution on questioning activities in the 4th plenary session of the 15th National Assembly

- Resolution on the 4th plenary session of the 15th National Assembly.

Resolution No. 76/2022/QH15 comes into force from December 30, 2022.

2. Solutions for reducing late payment of social insurance, health insurance and unemployment insurance premiums in the last months of 2022 of Vietnam

The Vietnam Social Security promulgated Official Dispatch No. 3511/BHXH-TST dated November 18, 2022 on solutions for reducing late payment of social insurance, health insurance and unemployment insurance premiums in the last months of 2022.

According to the Official Dispatch, in order to reduce late payment of social insurance, health insurance and unemployment insurance premiums in the last months of 2022, some tasks need to be carried out such as:

- Fully send notifications of results of payment of social insurance, health insurance and unemployment insurance, occupational accident and occupational disease insurance premiums (Using the Form No. C12-TS enclosed with Decision No. 595/QD-BHXH) to employers, thereby urging them to pay such premiums in full and on time.

- Assign leaders and officials to regularly update information on the operation, manufacture and trading of enterprises for urging enterprises to punctually pay social insurance, health insurance and unemployment insurance premiums and avoid incurring debts.

- Disclose on mass media enterprises which fail to pay or punctually pay large amounts of social insurance, health insurance and unemployment insurance premiums for a prolonged period.

- Inspect enterprises that pay social insurance premiums at least 03 months behind schedule and impose administrative penalties for all violations; etc.

3. Experiment provision of funeral benefits on Public Service Portal

On November 21, 2022, Vietnam Social Security promulgated Decision No. 3504/QD-BHXH on Process for pilot program for provision of funeral benefits according to procedures on Public Service Portal.

According to the Decision, beneficiaries of the pilot program include:

- Individuals applying for death certificates in the following cases:

+ A person dies while he/she was reserving his/her period of payment of social insurance premiums and he/she has paid his/her compulsory social insurance premiums for at least 12 months or the total period of payment of his/her compulsory and voluntary social insurance premiums is at least 60 months;

+ A person dies while he/she is participating in voluntary social insurance and he/she has paid his/her compulsory social insurance premiums for at least 12 months;

+ A commune official dies before reaching the age that is eligible for monthly pensions or allowance;

+ There is a request on the National Public Service Portal for provision of funeral benefits for a deceased person who was receiving monthly social insurance payout or pension.

- Related social insurance agencies, organizations and individuals in the procedures for provision as prescribed.  

In addition, accounts issued on Public Service Portal are needed to receive funeral benefits on Public Service Portal.

Decision No. 3504/QD-BHXH is effective from November 21, 2022 to December 20, 2022.

4. No visits to superior officials and political leaders during Tet Holiday in 2023 in Vietnam

This is the content in Directive No. 19-CT/TW dated November 18, 2022 on organization of Lunar New Year in 2023, promulgated by the Secretariat of the CPV Central Committee.

In the Directive, the Secretariat requests not to pay 2023 Tet visits to superior officials and political leaders; not to form Central delegations so as to pay Tet visits to Party committees and authorities of provinces and cities;

In addition, the Secretariat strictly forbids giving of Tet gifts to political leaders in any form; participation in pagoda festivals or other festivals without official assignment; participation in superstitious activities; use of the state budget, public vehicles and property in contravention of regulations.

Officials, party members and especially leaders of Party committees and organizations must really set an example in participating in a healthy, safe and thrifty New Year’s festival in 2023.

Directive No. 19-CT/TW is promulgated on November 15, 2022.
