In this week (from November 1 to November 6, 2021), LawNet has updated a number of outstanding documents as follows:
1. From 2022: Petrol price will be adjusted every 10 days in Vietnam
This is a remarkable content in Decree 95/2021/ND-CP of Vietnam amending and supplementing a number of articles of Decree 83/2014/ND-CP on petrol and oil trading.
Specifically, from January 2, 2022, the operating time for petrol prices is on the 1st, 11th and 21st of every month.
For the operating periods that coincide with a holiday or public holiday according to the regulations of the State, the operating time shall be postponed to the next working day after the holiday or public holiday. For the operating period that coincides with the Lunar New Year, the operating time is postponed to the next operating period.
In case the prices of petroleum products have abnormal fluctuations, greatly affecting socio-economic development and people's lives, the Ministry of Industry and Trade of Vietnam is responsible for reporting to the Prime Minister for consideration and decision on the adjustment of gasoline prices accordingly.
(Currently, according to Decree 83/2014 of Vietnam, the time between 02 consecutive price adjustments is at least 15 days in case of price increase, maximum of 15 days in case of price decrease).
Decree 95/2021/ND-CP of Vietnam takes effect from January 2, 2022.
2. Addition of fees for admission to the rank IV public officer promotion exam in Vietnam
This is a notable content in Circular 92/2021/TT-BTC of Vietnam stipulating the rate of collection, mode of collection, payment, management and use of fees for recruitment, competition for promotion and promotion of civil servants and public employees.
According to the Circular, the fee rates for recruitment, competition for promotion and promotion of civil servants and public employees are regulated as follows:
- Raising the rank of specialist, main specialist and equivalent; promotion to rank II, III and IV public employee professional titles:
+ Under 100 candidates is 700,000 VND/candidate/time.
+ From 100 - 500 candidates is 600,000 VND/candidate/time.
+ From 500 candidates or more is 500,000 VND/candidate/time.
(Compared to Circular 228/2016/TT-BTC, the fee for the promotion exam for rank IV public employees has been added).
- Raising the rank of senior specialist and equivalent, promoting the professional title of the first-class public employee:
+ Under 50 candidates is 1.4 million VND/candidate/time.
+ From 100 to 500 candidates is 1.3 million VND/candidate/time.
+ From 500 candidates or more is 1.2 million VND/candidate/time.
- Recruitment (including entrance exam, admission examination):
+ Under 100 candidates is 500,000 VND/candidate/time.
+ From 100 - 500 candidates is 400,000 VND/candidate/time.
+ From 500 candidates or more is 300,000 VND/candidate/time.
In addition, the level of re-examination for the recruitment examination, civil servant promotion, and public employee professional title promotion is 150,000 VND/test.
Circular 92/2021/TT-BTC of Vietnam takes effect from December 15, 2021.
3. 10 new points in Circular 78/2021/TT-BTC of Vietnam on e-invoices
The General Department of Taxation has issued Official Dispatch 4144/TCT-CS introducing new contents in Circular 78/2021/TT-BTC of Vietnam guiding invoices and documents.
According to the Dispatch, 10 new contents are introduced in Circular 78/2021/TT-BTC as follows:
(1) On authorization to issue electronic invoices (Article 3);
(2) Regarding the symbol of the model number, the symbol of the invoice, the name of the invoice (Article 4);
(3) Regarding the application of electronic invoices with tax authorities' codes (Article 5);
(4) Application of e-invoices to some other cases (Article 6);
(5) Handling errors in some cases (Article 7);
(6) E-invoices generated from cash registers (Article 8);
(7) Use of receipts and vouchers (Article 9);
(8) Criteria for an e-invoice service provider to sign an e-invoice service provision contract with tax authority's code and the service of receiving, transmitting and storing invoice data and other related services (Article 10);
(9) Effectiveness (Article 11);
(10) Forward processing (Article 12).
Official Dispatch 4144/TCT-CS was promulgated on October 28, 2021.
4. Promulgating 02 new circulars on the charter of intermediate schools and colleges in Vietnam
The Ministry of Labor, War Invalids and Social Affairs of Vietnam has promulgated Circular 14/2021/TT-BLDTBXH and Circular 15/2021/TT-BLDTBXH regulating the charter of secondary schools; College charter.
Both Circulars stipulate a number of notable new contents, such as:
- Additional types of secondary schools and colleges:
Specifically, Circular 14 and Circular 15 both add foreign-invested intermediate schools and colleges.
(Currently, there are only two types of secondary schools, public colleges and intermediate schools and private colleges).
- Regulating that principals of private intermediate schools and principals of private colleges are not officers, public servants or public employees.
(This is new content compared to the current regulations on the role and position of principals of middle schools and colleges) .
