Commercial mediation means a method of resolving commercial disputes agreed upon by involved parties with the assistance of a commercial mediator acting as an intermediary. Commercial mediation centers are organizations that carry out commercial mediation in Vietnam, of which the procedures for establishment and registration of operation are specified as follows:
Commercial mediation institutions are organizations that act as mediators to support the resolution of disputes agreed upon by the parties. According to Decree No. 22/2017/NĐ-CP of Vietnam’s Government, rights and obligations of commercial mediation institutions are specified as follows:
Commercial mediator may be an ad hoc commercial mediator or a commercial mediator of a commercial mediation institution who is selected by involved parties or appointed by a commercial mediation institution at the request of involved parties to assist them in dispute resolution. According to Decree No. 22/2017/NĐ-CP of Vietnam’s Government, rights and obligations of commercial mediators are specified as follows:
Persons who fully satisfies the criteria for a commercial mediator and wants to act as an ad hoc commercial mediator shall complete the registration procedures as prescribed in Article 8 of Decree No. 22/2017/NĐ-CP of Vietnam’s Government on commercial mediation.
Recently, the Government of Vietnam issued Decree No. 22/2017/NĐ-CP on commercial mediation, according to which the order and procedures for commercial mediation are specified as follows:
