1. Procedures for land allocation, land lease or change of land use purpose in Vietnam
The agency receives the document and returns the results of settlement of procedures for land allocation, land lease or land use purpose transfer as follows:
- The Department of Natural Resources and Environment in Vietnam receives the documents and returns the results to the cases specified in Clause 1, Article 59 of the Land Law;
- The Division of Natural Resources and Environment in Vietnam receives the dossiers and returns the results to the cases specified in Clause 2, Article 59 of the Land Law.
2. Procedures for registration of land and other land-attached assets; grant, exchange and re-grant of certificates in Vietnam
- The locality has established a land registry office:
The agency that receives the document and returns the results of the settlement of the land registration procedures and other land-attached assets; grants, exchanges or re-grants the certificate in Vietnam is the land registration office or the branch of the land registration office.
Based on specific conditions in the locality, the Provincial People's Committee promulgates regulations on receipt, rotation of documents, settlement and returns of results of settlement of land registration procedures and other land-attached assets; grant, exchange and re-grant certificates of assurance of time in accordance with law, publicity of administrative procedures and selection of places for submission of dossiers at the land registration office, one of the branches of the land registration office in the province or place according to the needs of land users and land-attached asset owners.
- The locality has not established a land registry office:
For places where the land registry office has not been established:
+ Provincial-level land use right registration offices receive documents for religious organizations and establishments, overseas Vietnamese implementing investment projects, foreign organizations, foreign individuals and foreign-invested enterprises;
+ District-level land use right registration offices receive documents for households, individuals, residential communities, overseas Vietnamese who own houses associated with land use rights in Vietnam.
- Special cases:
For households, individuals and communities need to submit documents at commune-level People's Committees, the commune-level People's Committees of the places where the land receives the documents and returns the results.
In case of registration of land fluctuations or land-attached assets; issue, change or re-grant of certificates, within 3 days after receiving the complete document, the commune-level People's Committee shall transfer the dossier to the Land Registration Office, the Branch of the Land Registration Office.
- The locality that has established the One-Stop Department:
The locality has organized a one-stop department to receive documents and return the results of administrative procedures settlement in accordance with the Government's regulations, the regulatory agencies receive documents and return the results through the one-stop department in accordance with the Decision of the provincial-level People's Committee, except for cases of receiving documents and returning the results of land registration procedures and other land-attached assets, granting, exchanging and re-granting certificates at locations outside the office of land registration, land registration office branches according to the needs of land users and land-attached asset owners.
- For procedures in high-tech parks, economic zones, airports, civil airports: Management Board of high-tech parks, economic zones; Airports are the focal point for receiving documents and returning the results of land administrative procedures in high-tech parks, economic zones, airports, civil airports.
