Regarding this issue, LawNet would like to answer as follows:

1. What is land registration office?

According to Clause 1, Article 1 of Joint Circular 15/2015/TTLT-BTNMT-BNV-BTC, land registration office is a public non-business unit under the Department of Natural Resources and Environment, which has the function of registering land, houses, and other land-attached assets;

Building, managing, updating, and uniformly adjusting cadastral records and land databases; making statistics and inventories of land; and providing land information to organizations and individuals as prescribed by law.

2. Operation mechanism of the Land Registration Office in Vietnam

The operation mechanism of the Land Registration Office according to Article 4 of Joint Circular 15/2015/TTLT-BTNMT-BNV-BTC is as follows:

* The land registration office implements the autonomy mechanism for public non-business units.

* Funding source for the Land Registration Office

- Funds guaranteed by the local budget, including:

+ Funds to ensure regular operations to perform the functions and tasks of the Land Registration Office (after balancing non-business revenues) according to current regulations;

+ Funds for performing tasks ordered by competent state agencies, unexpected tasks assigned by competent authorities;

+ Capital for capital construction, funds for equipment procurement, and major repairs of fixed assets in service of non-business activities of the unit according to projects approved by competent authorities;

+ Other expenses.

- Non-business income sources, including:

+ The portion of fees and charges collected shall be left to the unit for use in accordance with the State's regulations;

+ Revenues from service activities suitable to the professional fields and capabilities of the unit;

+ Other revenue (if any).

- Expenses, including:

+ Recurring expenses, including: expenses for regular activities according to functions and tasks assigned by competent authorities, expenses for regular activities in service of the collection of fees and charges for the unit, including:

Salary; wages, and salary allowances; deductions for payment of social insurance, health insurance, unemployment insurance, and trade union funds according to current regulations; public services; stationery; professional professional expenses; regular repair of fixed assets; and other expenses according to the prescribed regime;

+ Expenses for service activities, including: salary; wages, and salary allowances; deductions for payment of social insurance, health insurance, unemployment insurance, and trade union funds according to current regulations; raw materials, fuels, and materials; depreciation of fixed assets; fixed asset repair; paying taxes payable according to the provisions of law; other expenses (if any);

+ Non-recurring expenses, including:

++ Expenses for performing tasks ordered by competent state agencies and ad hoc tasks assigned by competent authorities. For tasks with economic and technical norms, the unit price promulgated by the competent authority shall comply with the prescribed unit price and the actual volume of performance.

For tasks without economic-technical norms, estimated unit prices, the State's current financial spending regime shall be complied with and approved by competent authorities;

++ Expenses for capital construction investment, equipment procurement, and major repair of fixed assets in service of non-business activities of the unit under projects approved by competent authorities;

++ Other expenses.

3. Tasks and powers of the Land Registration Office in Vietnam

According to Article 2 of the Joint Circular 15/2015/TTLT-BTNMT-BNV-BTC, the tasks and powers of the Land Registration Office in Vietnam are as follows:

- To register land assigned to the state, land use rights, ownership of houses, and other land-attached assets.

- To carry out the first grant, renewal, or re-grant of the Certificate of land use rights and ownership of houses and other land-attached assets (hereinafter referred to as the Certificate).

- To register changes in land allocated by the State for management, land use rights, ownership of houses, and other land-attached assets.

- To make, edit, update, archive, and manage cadastral records; receive and manage the use of Certificate blanks in accordance with law.

- To update, edit, synchronize, and exploit land data; build and manage the land information system according to the provisions of law.

- To make statistics, inventory the land and map the current status of land use; correct cadastral maps; and extract cadastral map data.

- To check the cadastral measurement of the land plot; inspect and certify diagrams of houses and other land-attached assets provided by organizations and individuals in the service of registration and issuance of certificates.

- To register transactions secured by land use rights, ownership of houses, and other land-attached assets in accordance with law.

- To provide documents, maps, information, and data on land, houses, and other land-attached assets to organizations and individuals in accordance with law.

- To collect fees and charges as prescribed by law.

- To perform services on the basis of functions and tasks in accordance with capacity as prescribed by law.

- To manage officials, employees, finances, and assets of the Land Registration Office in accordance with the law; implement the reporting regime according to current regulations; and assess the status of task performance in the assigned fields of work.
