What is construction planning? Bases for adjusting construction planning in Vietnam

1. What is construction planning?

Construction planning means the organization of spaces of urban and rural areas and particular-function zones;

The organization of technical and social infrastructure systems; the establishment of an environment suitable to people residing in territorial areas, ensuring the harmony between national interests and community interests, attaining the socio-economic development, national defense, security, environmental protection and climate change response objectives.

Construction planning is demonstrated through a construction plan consisting of diagrams, drawings, mock-ups and explanations.

Construction planning time limit means a duration identified to be the basis for forecast and calculation of economic-technical norms for formulation of a construction plan.

(Clause 30 and 44, Article 3 of Vietnam's Law on Construction 2014 amended in 2018)

2. Bases for adjusting construction planning in Vietnam

Article 35 of Vietnam's Law on Construction 2014 amended in 2018 stipulates the bases for adjusting construction planning as follows

- Inter-district construction planning and district construction planning shall be adjusted in one of the following cases:

+ Adjustments to the objectives of the socio - economic development strategy and industry distribution and development strategy change contents of the planning;

+ Adjustments to the planning at a higher level change contents of the planning or there is inconsistency with the planning at the same level;

+ Changes or adjustments to an administrative division affect the nature and scale of space of the planning;

+ Natural disasters, climate change and war change the objectives, orientations and spatial organization of the planning;

+ Random fluctuations of the socio-economic situation limit the resources for the implementation of the planning;

+ Development of science and technology considerably changes the implementation of the planning;

+ Assurance of nation defense and security is required.

- Dedicated area construction planning shall be adjusted in one of the following cases:

+ Adjustments to the planning at a higher level change contents of the planning or there is inconsistency with the planning at the same level;

+ Setting up a key project of national significance greatly affects land use, environment and spatial composition of the dedicated area;

+ Construction planning fails to be implemented or the implementation thereof exert adverse effects on socio - economic development, national defense, security, social security, historical - cultural sites/monuments or environmental ecology, which is determined through the review and assessment of implementation of construction planning and the community’s opinion;

+ Natural disasters, climate change and war change the objectives, orientations and spatial organization of the planning;

+ The planning serves national interests and community interests.

- Rural planning shall be adjusted in one of the following cases:

+ Adjustments to the planning at a higher level change are made;

+ Changes to natural geographical conditions are made;

+ Changes to an administrative division are made.”.

3. Checks on construction planning in Vietnam

In Article 2 of Vietnam's Decree 44/2015/ND-CP stipulates the review of construction planning as follows:

- Carrying out checks on construction planning is to control and evaluate the implementation of approved planning and is one of the foundations for decision on making adjustment to the planning.

- Reports on checks on construction planning include:

+ Check the formulation and development of related planning, construction projects under the approved construction planning and planning implementation plan.

+ Assess implemented targets, impacts and efficiency of implementation under the approved planning;

+ Analyze new elements during the implementation of construction planning and socio-economic development in the planned area;

+ Petitions and proposals

+ Reports on checks on construction planning include:

Written report, scale drawings (color drawings) and other relevant documents.
