What is social house?

Pursuant to the provisions of the Law on Housing 2014, it can be understood that social house is means any house provided for entities benefiting from the policies on housing support carried out by the State as prescribed in this Law.

Types of houses and standard areas of social houses in Vietnam

Pursuant to the provisions of Article 7 of Decree 100/2015/ND-CP and Article 1 of Decree 49/2021/ND-CP, types of houses and standard areas of social houses are specified below:

- If social houses are apartment buildings, the apartments must be enclosed structures that are designed and built in accordance with construction standards and regulations; the area of each apartment shall be between 25 m2 and 70 m2 and conformable with the construction planning approved by a competent authority.

The construction density or land use coefficient may be increased up to 1,5 times the applicable standard or standard promulgated by the competent authority. Such increase must be appropriate to the population target, technical infrastructure, social infrastructure, space and landscape architecture in the approved detailed planning and require approval the authority competent in approving the planning.

Depending on local conditions, the provincial People’s Committee may increase the maximum area of an apartment by up to 10%; number of apartments whose floor area is over 70 m2 must not exceed 10% of the total number of apartments of the social housing project.

- If social houses are row houses with few stories, the area of each house must not exceed 70 m2 and land use coefficient shall not exceed 2,0 according to the construction planning approved by the competent authority;

- The design of detached social houses invested by households and individuals must ensure construction quality, conformity with planning, and minimum requirements imposed by competent authorities. The Ministry of Construction shall provide specific guidance on design standards and minimum requirements for detached social houses.

Requirements pertaining to projects for social housing construction in Vietnam

Pursuant to Article 54 of the Law on Housing 2014, the requirements pertaining to projects for social housing construction include:

- Conform to requirements prescribed in Article 19 of the Law on Housing 2014; regarding the social housing construction which is not approved in the plans for housing development, the People’s Committee of the province shall consult the People’s Councils of province before granting the approval for the housing construction project.

- The People’s Committee of the province shall reserve a private area to set up a project for social housing construction for lease.

- With regard to a project for social housing construction which is not in the area required to set up private project for social housing construction for lease prescribed in Clause 2 of Article 54 of the Law on Housing 2014:

The investor shall reserve at least 20% of area of social housing in the project for lease; the investor is eligible for incentives for housing construction for lease as prescribed in Clause 1 Article 58 of the Law on Housing 2014 equivalent to such 20% of area and entitled to sell this house to the lessees as prescribed in regulations on social housing sale after 5-year-lease term.

- The projects for social housing construction must be managed their quality and standard areas, rents, lease-purchase prices, selling prices, and the approval of entities eligible for housing lease, lease purchase, or sale.
