Proposal to Amend Regulations on Planning in the Land Law

In the draft Law amending and supplementing laws with provisions related to planning, which is currently being consulted by the Ministry of Planning and Investment for public feedback, there are proposals to amend and supplement certain articles of the Land Law.

Draft proposal for amending regulations on the planning period and land use plan. The current regulations on the planning period and land use plan in the Land Law No. 45/2013/QH13 issued on November 29, 2013, are as follows: "The land use planning period is 10 years. The national-level, provincial-level and defense and security land use plan period is 5 years. The district-level land use plan is established annually".

The draft proposes amendments as follows: “The land use planning period is 10 years. The vision of the national land use planning is 30 to 50 years, the provincial and district levels are 20 to 30 years. The national and provincial land use plan period is 5 years; the district-level land use plan is established annually.”

At the same time, the draft also amends the content regarding national-level land use planning and plans.

Specifically, the basis for formulating national land use planning includes: The basis for planning according to the provisions of the law on planning; natural, socio-economic conditions; current land use status, land potential, and results of the previous national land use planning period; the land use needs of various sectors and provincial levels.

The formulation of national land use planning must comply with the provisions of the law on planning and ensure the determination and delineation of land use criteria for land groups down to each region and provincial administrative unit, including:

a) Agricultural land group, including: rice cultivation land (of which special-use wet rice cultivation land), protective forest land, special-use forest land, production forest land (of which production forest land is natural forest);

b) Non-agricultural land group, including: defense land; security land; industrial park land; export processing zone land; high-tech park land; economic zone land; urban land; rural residential area land; national infrastructure development land including: cultural facility construction land, medical facility construction land, education and training facility construction land, sports facility construction land, transportation land, postal and telecommunications works land; land with historical-cultural relics; and land for waste dumps and hazardous waste treatment.

c) Unused land group, including: unused land put into use and remaining unused land.

The basis for formulating the national land use plan includes: National land use planning; the five-year and annual socio-economic development plan of the entire country; the five-year land use needs of various sectors, fields, and provincial levels; the results of the implementation of the previous national land use plan; the investment capability, and resource mobilization to implement the land use plan.
