The government is consulting for draft Decree amending Decree on guidelines for the Land Law, which adds regulations on land prices to calculate rent land upon extension of land use in Vietnam.

Specifically, for land users whose land use term is extended by a competent state agency in Vietnam, the time of determining land price shall be specified as follows:
- In case the decision to extend the land use term coincides with the expiration of the land use term or after the expiration of the land use term, the time of land price decision is the last day of the land use term.
- In case a land user is entitled to an extension of land use term due to the adjustment of an investment project, the following procedures shall be followed:
+ If the land is used for the purpose for which it is leased by the state for a one-time rental payment for the entire lease period and the financial obligations as prescribed by law have been met, the land price shall be determined at the time of state approval.The country decides to extend the land use term.
The calculation of the additional collection of land rent during the remaining land use term shall comply with regulations of the Ministry of Finance of Vietnam;
+ If the land is used for state-leased land with an annual payment, the land price must be determined at the time the state decides on the land use extension in Vietnam in order to calculate and collect the annual land rental.
