Procedures for reducing land rent in 2021 under Vietnam's Decision 27/2021/QD-TTg

The Prime Minister of Vietnam has promulgated Decision 27/2021/QD-TTg on reducing the annual land rent 2021 for those affected by the Covid-19 epidemic. According to this Decision, the procedures and documents for land tenants to receive land rent reduction are prescribed as follows:

Step 1:  Applicants shall submit 1 application for land rent reduction (online or via other methods) to tax authority, Management Board of Economic Zones, Management Board of Hi-tech Zones, and other agencies according to regulations and law of Vietnam 

Application period: from September 25, 2021 to the end of December 31, 2021.

Note:   Application submitted from January 1, 2022 and onwards are not eligible for land rent reduction according to Decision 27/2021/QD-TTg.

Step 2:  Pursuant to the land rent reduction dossier submitted by the land tenant as prescribed; within 30 days from the date of receipt of complete and valid dossiers, the competent authority shall determine the reduced land rent amount and issue a decision on land rent reduction in accordance with the law on land rent collection.

Note:

- In case the land renter has been decided by a competent authority to reduce the land rent according to the provisions of Decision 27/2021/QD-TTg, but then the state management agency discovers through inspection and examination that the land rent is reduced. If the land tenant is not eligible for a reduction in land rent under Decision 27/2021/QD-TTg of Vietnam, the lessee must refund the reduced land rent to the state budget and the late payment interest calculated on the reduced amount under the provisions of the law on tax administration.

- In case the land renter has paid the land rent for 2021, but after the competent authority determines and decides to reduce the land rent, there is an excess of the land rent, the overpaid amount will be deducted from the land rent. of the following period or the year following the provisions of the law on tax administration and other relevant laws;

In case there is no longer a period to pay the next land rent, the overpaid amount shall be cleared or refunded as prescribed by law.

Application for land rent reduction

- The land renter's request for reduction of land rent in 2021, made according to the form in the Appendix issued with Decision 27/2021/QD-TTg .

- Decision on leasing land and Contract for renting land of competent authority (copies).

(Land lessees shall assume legal responsibilities for accuracy and truthfulness of information, application for land rent reduction, and beneficiaries of land rent reduction according to Decision 27/2021/ QD-TTg ).

Subjects entitled to the land rent reduction

Organizations, units, enterprises, households and individuals that are being directly leased land by the State under a decision or contract of a competent state agency in the form of annual land rental payment (applicable to both cases where the lessee is not eligible for land rent exemption or reduction and the land renter is receiving a reduction in land rent in accordance with the land law and other relevant laws) .

Land rent reduction

- Reduce 30% of payable land rent for land lessees under Article 2 hereof; do not take into account land rent of previous years and fine for late payment (if any).

Note:

- No reduction on the outstanding land rent of the years before 2021 and late payment interest (if any).

- In case land lessees are benefitting from land rent reduction, the 30% reduction shall be calculated based on the reduced land rent as per the law.

Decision 27/2021/QD-TTg of Vietnam takes effect from September 25, 2021.
