This is a notable content stipulated in the Law on Amendments to the Law on Construction 2020, which was officially signed into law by the National Assembly on June 17, 2020, and will take effect from January 1, 2021.
According to Amended Construction Law 2020, it is stipulated that “A construction work is a product constructed according to design, formed by human labor, building materials, and equipment installed into the work, connected and located to the land, which may include underground, above-ground, underwater, and above-water parts.”

According to the new concept of construction works above, the Law also clearly stipulates the type and grade of construction works as follows:
1. Types of construction works are determined according to the nature of the structure and the function of the work.
2. Grades of construction works are determined for each type of work including:
a) Grades of construction works serving the management of construction investment activities as stipulated in this Law, determined based on the scale, importance level, and technical specifications of the work, including special grade, grade I, grade II, grade III, and grade IV, except for the cases specified at point b of this clause;
b) Grades of construction works serving the design of construction works are specified in standards and technical regulations. Grades of works serving the management of other contents are implemented according to relevant legal regulations.
Amended Construction Law 2020 has more clearly defined the types and grades of construction works compared to Construction Law 2014, specifically:
- At Clause 2, Article 5 of Construction Law 2014, it is stipulated that “The types of works are determined according to their functions, including civil works, industrial works, traffic works, agricultural and rural development works, technical infrastructure works, and defense and security works.”
From 2021, the type of construction works must be determined according to the nature of the structure and the function of the work. Therefore, the types of construction works must now be more detailed and specific compared to current regulations.
- According to Clause 3, Article 5 of Construction Law 2014, it is stipulated: “The grade of works is determined for each type of work based on the scale, purpose, importance, lifespan, used materials, and technical requirements for building the works.”
However, under the new regulations in Amended Construction Law 2020, the grade of construction works is determined for specific types of works, including: Grades of construction works serving the management of construction investment activities and grades of construction works serving the design of construction works are determined based on the scale, importance level, and technical specifications of the work, including special grade, grade I, grade II, grade III, and grade IV, and technical standards and regulations for the grade of construction works serving the design of construction works.
