Amendments to the procedures for issuing LURC when changing the land use purpose in Hanoi, Vietnam (Illutration)

According to the regulations in Vietnam, from June 25, 2022, the order and procedures for granting certificates to households and individuals that are allocated land, leased land by the State; changes the land use purpose; won the auction of land use rights or the auction to buy land are as follows:

1. Dossier for issuance of LURC when changing land use purpose in Hanoi, Vietnam

The District People's Committee and the Auction Organizing Unit are responsible for transferring the original dossier to the branch of the Hanoi Land Registration Office where the land is located.

(Compared to the current, the regulations which land users shall be the one to submit the dossier have been removed)

2. Procedures for issuance of LURC when changing land use purpose in Hanoi, Vietnam

- Within 05 working days from the date of receiving the application, the branch of the Land Registration Office is responsible for:

+ Checking profile; sending cadastral data to the Sub-department of Taxation to determine financial obligations in case of having to fulfill financial obligations or determining land rental unit prices.

+ Carrying out procedures to submit to the People's Committee of the district (where the land is located) to sign and issue the Certificate after the land user submits sufficient documents to prove the fulfillment of financial obligations (for cases where financial obligations must be fulfilled).

(Current regulation fully annuls the responsibility of printing the Certificate of the Branch of the Hanoi Land Registry Office)

- Within 02 working days, the People's Committee of the district is responsible for signing and granting the Certificate.

- Within 01 working day from the date the district-level People's Committee signs the Certificate, the branch of the Hanoi land registration office is responsible for:

+ Updating and supplementing the issuance of Certificates in the cadastral dossiers, land databases and send documents to relevant agencies to update and correct changes in land use rights in the cadastral records of the City in Vietnam.

+ Collecting fees and charges as prescribed and giving the Certificate to the grantee.
