1. What is a Personal Identification Number (PIN)?
According to Article 13 of Decree 137/2015/ND-CP, a personal identification number is a sequence of natural numbers consisting of 12 numbers; has a structure of 6 numbers, which are the birth century code, gender code, citizen's year of birth code, province code, central city or country code where the citizen registered his birth; and 6 numbers are random numbers.
2. Procedures for issuing personal identification numbers in Vietnam
2.1. Procedures for issuing personal identification numbers to citizens who are applying for birth certificates in Vietnam
Procedures for granting personal identification numbers to citizens with birth registration are specified in Article 14 of Decree 137/2015/ND-CP, as follows:
- In case the electronic civil status database has been connected to the national population database, when receiving enough papers for birth registration, the civil status management and registration agency shall be the electronic civil status database's responsible for immediately transferring the information of the person whose birth is registered to the National Population Database, in which the following information must be collected to issue a personal identification number:
+ Full name, middle name and birth name;
+ Date of birth;
+ Gender;
+ Registration of birthplace;
+ Hometown;
+ Ethnicity;
+ Nationality;
+ Full name, middle name, and the name and nationality of the parents or legal representative, unless they have not been identified.
The head of the agency managing the national population database of the Ministry of Public Security is responsible for checking information and documents as prescribed at Point b, Clause 3, Article 13 of the Law on Citizen Identification, and immediately issuing and transferring the identification number to the population database. personal names for civil status registration and management agencies.
- In case the national population database has not been operated or the electronic civil status database has not been connected to the national population database: Upon receiving the citizen's birth registration application, the civil status registration and management agency shall immediately transfer the above information to the agency managing the national population database via the internet for which the account has been granted.
The agency managing the national population database is responsible for granting access accounts to civil status registration and management agencies; immediately transfers the citizen's personal identification number to the civil status registration and management agency when receiving birth information as prescribed via the internet. Civil status registration and management agencies are responsible for keeping their access accounts confidential in accordance with the law on the protection of state secrets.
2.2. Procedures for assignment of personal identification numbers to citizens having birth certificates in Vietnam
Procedures for granting personal identification numbers to citizens who have registered their births are specified in Article 15 of Decree 137/2015/ND-CP (amended by Decree 37/2021/ND-CP) as follows:
- The database management body shall assign personal identification numbers (“PIN”) to citizens who have a birth certificate but no PIN based on information available in the national population database.
- After assigning PIN to a citizen, the database management body shall issue a written notification of the assigned PIN and information on the citizen available in the national population database to the citizen.
If the citizen’s information in the database is inadequate, the notification shall include a request for the citizen to provide the missing information for the police of the commune where the citizen lives to have their information in the database updated or edited.
- For any citizen who already has PIN but has undergone sex reassignment or changed their birth year, the database management body shall assign another PIN to the citizen after the citizen finishes registering information concerning their sex or birth year according to regulations of law on civil registration.
The database management body shall notify the new PIN to the citizen in writing.
- Identity card issuing authorities shall use PINs assigned by the database management body to issue identity cards according to regulations in Article 18 of the Decree 137/2015/ND-CP.
