1. Form of maternity leave confirmation and instructions on how to fill it

The form of maternity leave confirmation is specified in Appendix 6 of Circular 56/2017/TT-BYT.

* How to fill a form of maternity leave confirmation

(1) The part of the social insurance number or health insurance card:

Enter the social insurance book number or the social insurance number. The recording of the social insurance number is only required when the official social insurance agency gives notice of the use of the social insurance number instead of the social insurance book number.

(2) Diagnostic part:

A description of the medical condition or the name of the illness must be specified. In the case of a disease requiring long-term treatment, write the disease code; if there is no disease code, write the full name of the disease. The recording of disease codes and disease names comply with the provisions of Circular No. 46/2016/TT-BYT dated December 30, 2016 of the Minister of Health promulgating the list of long-term diseases;

(3) Number of days off:

- The decision on the number of days off must be based on the patient's health condition but must not exceed 30 days for a certificate of maternity leave.

- The recording of the start date of the leave must coincide with the date of the patient's visit.

For example, if the date of examination is July 13, 2018 and the patient needs to take 30 days off, write 30 days and specify the dates from July 13, 2018 to August 11, 2018.

- If the certificate of maternity leave is reissued, the start date of the leave must still coincide with the date of the patient's visit to the clinic. Particularly, the date of issuance of the certificate must be written in accordance with reality.

Example: On July 14, 2018, Ms. Nguyen Tuyet A was granted a certificate of maternity leave for a period of 30 days from July 14 to August 12, 2018.

On September 15, 2018, Ms. Nguyen Tuyet A submitted a written request for re-issuance of the certificate of maternity leave, and on September 16, 2018, the establishment re-issued the certificate of maternity leave. The recording of maternity leave is done as follows:

The diagnosis section clearly states the name of the disease according to the diagnosis.

The number of days off for medical treatment is 30 days, and it clearly states that it is from July 14, 2018 to August 12, 2018.

The date next to the upper part of the phrase "Y, medical doctor" is dated September 16, 2018.

(4) Confirmation from the unit head

The head of the medical examination and treatment establishment or the person authorized by the head of the medical examination and treatment establishment may sign and seal the medical examination and treatment establishment's seal.

2. Authority to issue maternity leave confirmations in Vietnam

Clause 1, Article 18 of Circular 56/2017/TT-BYT stipulates the authority to issue maternity leave confirmations in Vietnam as follows:

- Any licensed general hospital having an obstetrics department or maternity hospital may issue maternity leave confirmations due to obstetric diseases;

- Any licensed general hospital or Medical Assessment Council may issue maternity leave confirmations due to sickness;

- Practitioners at a health facility specified in Point a or b of this Clause may issue maternity leave confirmations due to obstetric diseases or sickness as authorized by the head of such facility.
