Procedures for death registration in Vietnam in 2022

Within 15 days from the date of death, the responsible person must register the death. The following is the procedure for death registration in Vietnam.

1. Registration of death at commune-level People's Committees of Vietnam

1.1. Competence of commune-level People's Committees to register deaths

Commune-level People's Committees of last places of residence of deceased persons shall register death. If the last place of residence of the deceased person is not identifiable, the commune-level People's Committee of the locality where the deceased person dies or his/her body is found shall register his/her death.

1.2. Death registration procedures at commune-level People's Committees

Step 1: The person responsible for death registration shall submit the death declaration, made according to a set form, and the death notice or other substitute paper of death notice to the civil status registration agency.

Step 2: Immediately after receiving papers as prescribed, if seeing that the death declaration is proper, the justice and civil status officer shall record the death declaration in the civil status book and together with the death declarant sign in the civil status book and report to the chairperson of the commune-level People's Committee to issue an extract to the death declarant.

The justice and civil status officer shall close civil status information of the deceased person in the electronic civil status database.

2. Death registration procedures at district-level People's Committees of Vietnam

2.1. Competence to register deaths of district-level People's Committees

- District-level People's Committees of the last places of residence of the deceased persons shall register death for foreigners or Vietnamese citizens residing abroad who die in Vietnam.

- If the last place of residence of the deceased person is not identifiable as prescribed above, the district-level People's Committee of the locality where the deceased person dies or his/her body is found shall register his/her death.

2.2. Death registration procedures at district-level People's Committees

- Step 1: The death registrant shall submit the declaration, made according to a set form, and the death notice or other substitute paper to the civil status registration agency.

- Step 2: Immediately after receiving complete papers as prescribed, if seeing that the death declaration is proper, the civil status officer shall record it in the civil status book and together with the death declarant sign in the civil status book. The district-level Justice Division shall report to the chairperson of the district-level People's Committee to issue civil status extracts to death registrants.

The required verification may be carried out within 03 working days, if necessary.

- Step 3: After death registration, district-level People's Committees shall send written notices enclosed with civil status extracts to the Ministry of Foreign Affairs for notification to competent agencies of countries of which deceased persons are citizens.

In case the deceased person is a Vietnamese citizen residing abroad, the civil status officer shall close the information of the deceased person in the electronic civil status database.

3. Registration of death at representative missions of Vietnam

3.1. Competence of representative missions to register death

- The representative missions shall carry out death registration for Vietnamese citizens residing abroad, if such registration is not contrary to the laws of receiving countries and International treaties of which Vietnam is a member.

- For countries which have two or more representative missions in Vietnam, the civil status registration competence of the representative missions in consular regions where the requesters reside is required. For countries which have not yet had representative missions, civil status registration shall be performed at the representative mission in country part-time or the most convenient representative mission.

3.2. Death registration at representative missions

Step 1: The death registration applicants shall submit the death registration declarations (made according to a set form) and death notices or other substitute papers issued by foreign competent bodies.

Step 2: Immediately after receiving complete dossiers, if seeing that the death declaration is proper, the consul shall record it in the death registration book and together with the death declarant sign in the civil status book. The representative mission's head shall sign the extract of death certificate issued to the applicant for death registration.

The required verification may be carried out within 03 working days, if necessary.

Other papers substituting for death notices include:

- For a person who dies due to execution of the death sentence, the chairman of the death sentence execution council shall issue a written certification of replacement of the death notice;

- For the person who is declared dead by the court, the effective judgment or decision of the court shall replace the death notice;

- For the persons who die in the vehicles or die due to accident, die unforeseen, sudden or die without suspicion, the written certification of police or expertise result of forensic examination agency shall replace the death notice;

- For a dead person not falling into any of the cases specified at Points a, b, c and d of this Clause 2, Article 4 of Decree No. 123/2015/ND-CP, the commune-level People's Committee of the place in which he/she dies shall issue a death notice.
