1. Is installing a camera on someone else's house considered invasion of privacy in Vietnam?

According to the Vietnam's Constitution 2013, everyone has the right to inviolability of private life, personal secrets and family secrets; and has the right to protect his or her honor and reputation.

The security of information about private life, personal secrets or family secrets shall be guaranteed by law.

In addition, Clauses 1 and 2 of Article 38 of the Civil Code 2015 stipulate the rights to private life, personal secrets, and family secrets as follows:

- The private life, personal secrets and family secrets of a person are inviolable and protected by law.

- The collection, preservation, use and publication of information about the private life of an individual must have the consent of that person; the collection, preservation, use and publication of information about the secrets of family must have the consent of all family’s members, unless otherwise prescribed by law.

Therefore, the act of installing a camera facing a neighbor's house can be considered an invasion of another's privacy.

2. What to do when being monitored by a neighbor's camera in Vietnam?

According to Article 11 of the Civil Code 2015, If a person has his/her civil rights violated, he/she may protect them himself/herself as prescribed in this Code, other relevant laws or request competent authorities to:

- Order the termination of the act of violation.

- Order compensation for damage.

Thus, if you feel that such behavior affects your privacy, you have the right to ask the authorities to intervene, force the termination of the above work, or sue.
