How to register copyright is guided in Decision 3684/QD-BVHTTDL 2022 as follows:

1. Copyright registration documents in Vietnam

Copyright registration documents include:

(1) Copyright registration declaration (Form No. 01 issued with Circular 08/2016/TT-BVHTTDL).

Copyright registration declaration

The declaration must be made in Vietnamese, signed by the author, copyright owner or person authorized to submit the application, and include complete information about:

+ Applicant, author, copyright owner;

+ Summary of the work's content;

+ Author's name and work used as a derivative work if the work is registered as a derivative work;

+ Time, place, and form of announcement;

+ Commitment to responsibility for the information stated in the application;

(2) Two copies of the copyrighted work;

(3) Power of attorney, if the applicant is the authorized person;

(4) Documents proving the right to apply if the applicant enjoys that right of another person due to inheritance, transfer, or inheritance;

(5) Written consent of the co-authors, if the work has co-authors;

(6) Written consent of the co-owners, if the copyright is jointly owned.

Documents specified in points 3, 4, 5, and 6 must be made in Vietnamese; if they are made in a foreign language, they must be translated into Vietnamese.

2. Copyright registration procedures in Vietnam

- Authors and copyright owners can directly or authorize other organizations or individuals to submit a copyright registration application at the headquarters of the Copyright Office or Representative of the Copyright and Related Rights Registration Department of the Copyright Department in Ho Chi Minh City, Representative of the Copyright and Related Rights Registration Department of the Copyright Department in Da Nang City, in one of the following ways:

+ Submit directly;

+ Send by post.

- Within 15 working days from the date of receipt of a valid application, the Copyright Office shall issue a Copyright Registration Certificate. In the event of a refusal to issue a Copyright Registration Certificate, a written notice must be given to the applicant.

3. Copyright registration fee in Vietnam

- Fee for issuing a Copyright Certificate: 100,000 VND/Certificate, applicable to the following types of works:

+ Literary, scientific works, textbooks, course books, and other works expressed in the form of writing or other characters (collectively referred to as types of written works);

+ Lectures, speeches and other talks;

+ Journalism works;

+ Musical works;

+ Photographic works.

- Fee for issuing a Copyright Certificate: 300,000 VND/Certificate, applicable to the following types of works:

+ Architectural works;

+ Maps, diagrams, maps, and drawings related to topography and scientific works.

- Fee for issuing a Copyright Certificate: 400,000 VND/Certificate, applicable to the following types of works:

+ Visual works;

+ Works of applied art.

- Fee for issuing a Copyright Certificate: 500,000 VND/Certificate, applicable to the following types of works:

+ Cinematic works;

+ Theatrical works are fixed on tapes and discs.

- Fee for issuing a Copyright Certificate for computer programs, data collection, or programs running on computers: 600,000 VND/Certificate.
