"Suspended sentence means the conditional exemption from execution of the penalty of imprisonment which is applied by the court to an offender who is sentenced to termed imprisonment not more than 3 years, when the court, based on the personal background of the offender and extenuating circumstances, sees it unnecessary to compel the execution of the imprisonment" (Article 1 Resolution 01/2013/NQ-HDTP)
The determination of the penalty for an offender must be based on various factors, one of which is the stage of committing the crime. The 2015 Vriminal Code does not specifically stipulate the stages of a criminal act. However, based on the manifestations, signs, and developments of the act, it can be divided into four main stages: Preparation for a crime, attempted crime, completed crime, and voluntary abandonment of the crime halfway.
August 9, 2017, the Supreme People's Procuracy of Vietnam issued Official Dispatch 3010/VKSTC-V14 guiding the implementation of certain provisions in Resolution 41/2017/QH14 on the enforcement of the 2015 Criminal Code.

As of the present time, the Criminal Code in Vietnam being applied is the Criminal Code 2015 and the Law Amending the Criminal Code 2017. Although the Criminal Code 1999 is no longer in effect, certain guiding documents are still applicable because they remain in force.
