the Government of Vietnam promulgates Decree 98/2019/ND-CP amending and supplementing certain articles of decrees in the field of technical infrastructure.
Section 1 of Article 3 of Decree 98/2019/ND-CP amends and supplements Section 1 of Article 20 of Decree 23/2016/ND-CP, stipulating that cremation facilities must be constructed in conformity with the urban and rural system planning, provincial planning, construction planning or relevant sector planning, and detailed planning for cremation facilities approved by competent authorities.

Decree 23 stipulates that for cremation facilities constructed outside of cemeteries, the environmental safety distance from the cremation facility to residential areas and public works must ensure a minimum of 500 meters. Solid waste generated from the activities of such facilities must be collected, transported, and treated according to environmental regulations. Cremation facilities, when put into use, must have management regulations in place.
Investors in constructing cremation facilities are entitled to incentives regarding: investment in building technical infrastructure; land and site clearance; capital mobilization and taxes as per current legal regulations.
Additionally, users of cremation services are supported with cremation costs, transportation costs, and other costs (if any). The provincial People's Committee, based on the local socio-economic conditions, stipulates the support for cremation costs, transportation costs, and other costs (if any) for users of cremation services.
