The National Assembly approved the Law on the Organization of the Government of Vietnam 2025 on February 18, 2025.

According to Article 25 of the Law on the Organization of the Government of Vietnam 2025, the working regime of the Government of Vietnam and each member of the Government are as follows:

- The working regime of the Government of Vietnam, the members of the Government of Vietnam is implemented on the basis of clearly delineating functions, tasks, powers, and emphasizing the responsibility of the Prime Minister of the Government of Vietnam and each member of the Government as prescribed by law.

- The Government of Vietnam works following the collective policies, deciding by majority.

- The Government of Vietnam promulgates the Working Regulations of the Government of Vietnam.

Duties and powers of the Prime Minister of the Government of Vietnam

According to Article 13 of the Law on the Organization of the Government of Vietnam 2025, the Prime Minister of the Government performs duties and powers as stipulated by the Constitution, laws, resolutions of the National Assembly, ordinances, resolutions of the Standing Committee of the National Assembly and the following duties and powers:

- Submit to the National Assembly for approval the proposal for the appointment, dismissal, removal of Deputy Prime Ministers, Ministers, and Heads of Ministry-level agencies; during the period when the National Assembly is not in session, submit to the President the decision to temporarily suspend the work of the Deputy Prime Ministers, Ministers, and Heads of Ministry-level agencies;

- Submit to the Standing Committee of the National Assembly for approval the proposal to appoint and dismiss ambassador extraordinary and plenipotentiary of the Socialist Republic of Vietnam;

- Submit to the President to decide on the following contents:

+ Award orders, medals, state awards, state honorary titles; decide on nationality acquisition, release, restoration, or revocation of Vietnamese nationality;

+ Confer, promote, demote, strip military ranks of generals, rear admirals, vice admirals, admirals of the navy; appoint, dismiss, and remove the Chief of the General Staff, Chairman of the General Political Department of the Vietnam People's Army;

- Lead the work of the Government; lead, direct the development of policies, laws and organize the implementation of the Constitution, laws, and perform specific duties and powers as follows:

+ Convene and chair meetings of the Government, decide on the Government's work program, the Prime Minister's work program;

+ Lead, direct the development of legal documents and strategy, planning, plan, policy, and other projects under the decision-making authority of the Government, the Prime Minister;

+ Direct, coordinate activities among members of the Government; decide on issues when there are differing opinions among Ministers, Heads of Ministry-level agencies;

+ Lead, direct the People's Committees, Presidents of the Provincial People's Committees in executing law provisions and program, plan, strategy of the Government in management fields such as economy, culture, society, education, health, science, technology, environment, information, communication, foreign affairs, and international integration, national defense, national security, social order, and safety;

+ Lead, direct, inspect, and handle violations in the process of implementing the Constitution and laws nationwide;

+ In case of genuine necessity for the national interest, preventing and combating natural disasters, diseases, ensuring the life, and property of the People, the Prime Minister decides on urgent measures as prescribed by the current law, reporting to the competent authority of the Communist Party, National Assembly at the nearest time.

- Lead and take responsibility for the activities of the state administrative system from central to local level:

+ Manage and operate activities of the state administrative system from central to local levels in serving the People, carrying out economic, cultural, social, education, health, science, technology, environment, information, communication, foreign affairs, and international integration, national defense, national security, social order and safety tasks;

+ Lead, direct the state management over officials and public employees in state agencies from central to local levels;

+ Lead, direct, organize inspection and examination of official activities in the state administrative system;

+ Lead, direct the management and operation of all physical facilities, finances, and state budget resources to serve the operation of the state apparatus;

+ Lead, direct the administrative reform and public policy reform, official within the state administrative system from central to local levels;

+ Lead, direct, inspect activities of Ministers, Heads of Ministry-level agencies, local governments, and heads of agencies, units in the state administrative system from central to local levels;

- Issue decisions, directives and guide, inspect the implementation of those documents within the administrative agencies' system from central to local levels and decide specific contents as follows:

+ During the period when the National Assembly is not in session, decide on assigning acting Ministers, Heads of Ministry-level agencies in case of vacancies; during the interval between two provincial People's Council sessions, decide on assigning acting Chairman of the Provincial People's Committee in case of vacancies;

+ Appoint, dismiss, temporarily suspend, remove from office, resign Deputy Ministers, equivalent positions of Ministries, Ministry-level agencies; decide on appointing, dismissing, removing heads, and deputy heads of government-affiliated agencies and other titles according to the personnel management decentralization of the competent level;

+ Approve the election, dismissal, and decide on the transfer, removal of the Chairman, Vice Chairman of the Provincial People's Committee; temporarily suspend the work of the Chairman of the Provincial People's Committee; request the Chairman of the Provincial People's Committee to implement the suspension, removal according to the personnel management decentralization with the Vice Chairman of the Provincial People's Committee, Chairman, Vice Chairman of the subordinate People's Committee when not completing tasks assigned by the competent level or violating the law;

+ Decide on establishing, reorganizing, dissolving agencies, other organizations under the Provincial People's Committee as prescribed by law; decide on establishing councils, committees, or boards when necessary to assist the Prime Minister in researching, directing, coordinating, and resolving important multi-sectoral issues.

The Law on the Organization of the Government of Vietnam 2025 takes effect from March 1, 2025.

The Law on the Organization of the Government of Vietnam 2015 (amended and supplemented by Law No. 47/2019/QH14 and Law No. 20/2023/QH15), ceases to be effective from the date the Law on the Organization of the Government of Vietnam 2025 comes into effect.
