Regarding this matter, LawNet would like to answer as follows: 

On April 2nd, 2024, the Steering Committee for Administrative Reform of the Government issued Decision 48/QD-BCDCHC on the Operation Regulations of the Steering Committee for Administrative Reform of the Government of Vietnam.

Working principles of the Steering Committee for Administrative Reform of the Government of Vietnam

According to Article 2 of the Regulations attached to Decision 48/QD-BCDCHC, the working principles of the Steering Committee for Administrative Reform of the Government of Vietnam are as follows:

- The Steering Committee works based on the principles of democratic centralism, emphasizing the responsibility of the leaders and promoting the collective intelligence of its members; ensuring close coordination, unity in direction, management, and exchange of information for problem-solving according to the functions, tasks, and powers of the member agencies as prescribed by law.

- Each member of the Steering Committee upholds personal responsibility in the activities of the Steering Committee and in carrying out assigned tasks and powers; resolving tasks within their jurisdiction and assigned responsibilities in accordance with the prescribed procedures and regulations of the law and Regulations attached to Decision 48/QD-BCDCHC.

- Members of the Steering Committee have a responsibility to fully participate in the activities of the Steering Committee; implement and be accountable to the Head of the Steering Committee for the assigned tasks.

 

Working regime and working relationship of the Steering Committee for Administrative Reform of the Government of Vietnam

(1) Meetings of the Steering Committee

- The Steering Committee holds regular meetings every 6 months/1 time to evaluate the overall situation, the results of implementing the directives and management of the members of the Steering Committee, or in-depth evaluations on specific topics, and determine the program and work plan for the next period.

- When required or when specific guidance is needed, the Head of the Steering Committee decides to hold an emergency meeting with the entire Steering Committee or with some members of the Steering Committee. The Head of the Steering Committee decides to invite representatives who are not members of the Steering Committee to attend the meetings of the Steering Committee.

- Conclusions of the Head of the Steering Committee or the Deputy Head of the Steering Committee are expressed through official notifications of the Steering Committee.

(2) Working regime and coordination mechanism

- The members of the Steering Committee work under concurrent position policies. The Head of the Working Direction Board and the Deputy Head of the Steering Committee, who are Deputy Prime Ministers, use the seal of the Prime Minister, while other members use the seal of their own agencies.

- The Head of the Steering Committee and the Deputy Head of the Steering Committee regularly work with members of the Steering Committee, ministries, sectors, and localities according to the plan or as needed to receive reports on the situation and provide guidance on the implementation of the programs and work plans of the Steering Committee.

- The members of the Steering Committee have the authority to assign leading units, mobilize resources and personnel of their agencies to fulfill tasks assigned by the Head of the Steering Committee or the Deputy Head of the Steering Committee; coordinate with the Steering Committee in implementing tasks; report to the Head of the Steering Committee on the results of implementation.

- The members of the Steering Committee are responsible for reporting on the implementation of assigned tasks in their respective areas every quarter/1 time; they are accountable for information, reports, and results of the assigned tasks within their management scope.

(3) Operational budget

- The operational budget of the permanent office of the Steering Committee and the Office of the Steering Committee is ensured by the state budget, allocated from the regular operational budget of the Ministry of Home Affairs and other legal funding sources.

- The operational budget of the members of the Steering Committee at ministries and agencies is ensured by the state budget, allocated from the regular operational budget of the respective ministries, agencies, and other legal funding sources.

- The establishment, management, and use of the operational budget of the Steering Committee are carried out according to the provisions of the law.
