Working Hours and Rest Periods for Domestic Workers

For domestic work, the nature of this job has distinctive characteristics compared to other ordinary jobs. Therefore, labor law has specific regulations on working hours and rest periods for domestic workers.

The regular working hours for employees are 08 hours/day and 48 hours/week. However, for domestic workers, working hours are regulated as follows:

- Working hours and rest periods are agreed upon by both parties, but domestic workers must have at least 8 hours of rest, including 6 consecutive hours within every continuous 24-hour period.- Working hours for minor domestic workers aged from 15 to under 18 years shall not exceed 08 hours/day and 40 hours/week.

Regarding weekly rest time, domestic workers are entitled to at least 24 consecutive hours of rest. In cases where this is not possible, the employer must ensure that the worker receives an average of at least 04 days off per month. The specific rest time will be agreed upon by both parties.

Annual leave, holiday, and Tet holidays for domestic workers are similar to the regulations for annual leave, holiday, and Tet holidays for regular jobs, which are:

- During holiday and Tet days as specified under Article 115 of the Labor Code 2012, domestic workers are entitled to leave with full pay.- Domestic workers who have completed 12 months of work for an employer are entitled to 12 working days of annual leave with full pay, with the time of leave agreed upon by both parties. Additionally, domestic workers may receive an advance payment of at least the equivalent of their salary for the days of annual leave.
