This is a noteworthy provision mentioned in Decree No. 91/2017/ND-CP providing guidance on the Law on Emulation and Commendation (effective from October 01, 2017).
Nghi dinh 91 specifies: No consideration for the title of "Advanced Laborer" or "Advanced Soldier" in the following 02 cases:
- Individuals newly recruited for less than 10 months;- Disciplinary measures from reprimand level or higher.
According to Decree 91, the consideration for awarding the title of "Advanced Laborer" or "Advanced Soldier" has “special benefits” for the following individuals:
- Individuals participating in combat, serving in combat, or performing brave acts to save people or state/property, resulting in injuries requiring treatment and nursing as concluded by district-level or equivalent medical facilities, the time for treatment and nursing will be considered for the title award;- Individuals sent for short-term training and education under 01 year, who comply well with the regulations of the training and educational institution, the training period will be counted as working time in the agency, organization, or unit for the title consideration.
In cases where individuals are sent for training and education for 01 year or more, complying well with the regulations of the training and educational institution, achieving study results of good grade or higher will be considered for the title award;- Maternity leave according to regulations will still be counted for the title consideration;- For individuals transferring work, the new agency, organization, or unit is responsible for considering and awarding the title of "Advanced Laborer" or "Advanced Soldier" (case where the individual has worked at the old agency for 06 months or more must have comments from the old agency).
In the case of individuals being sent on assignment or secondment to other agencies, organizations, units for a certain period, the consideration for awarding the title of "Advanced Laborer" or "Advanced Soldier" will be decided by the agency, organization, or unit that sent the individual on assignment or secondment and confirmed by the agency, organization, or unit that received the assigned or seconded individual.
