Recently, the Government of Vietnam issued Decree 119/2020/ND-CP on penalties for administrative violations in journalistic and publishing activities.
Will act of providing false and untruthful information for the press be fined in Vietnam? (Illustrative image)
Article 9 Decree 119/2020/ND-CP stipulates that a fine from VND 1,000,000 to VND 3,000,000 for the action below:
+ Prevent the institution and individual from providing information to the press;
+ Failure to provide the press with information according to clause 1 Article 38 of the Law on Press;
+ Failure to comply with regulations on time limit for notification or deadline for posting responses to comments, criticisms, complaints or requests of organizations or individuals.
- A fine from VND 10,000,000 to VND 15,000,000 for the action below:
+ Inaccurate and untruthful presentation of the interviewees' answers;
+ Failure to implement the interviewee request for reviewing the article by the interviewee before posting the interview;
+ Using the opinions expressed at the conference, seminar, meeting, exchange or talk to convert them into the interview without the speaker's consent;
+ Provide false and untruthful information for the press.
Note: For acts of misrepresenting or inaccurately reflecting the content of interviews, or using statements made at conferences, seminars, meetings, exchanges, or discussions to create interview articles without the consent of the speaker, in addition to fines, the violator must also correct and apologize.
More details can be found in Decree 119/2020/ND-CP, which comes into force in Vietnam from December 1, 2020.
