Regarding this issue, LawNet would like to answer as follows:

On August 6, 2023, the Prime Minister of Vietnam issued Decision 932/QD-TTg establishing the Prime Minister's Administrative Procedure Reform Working Group.

1. Who is the leader of the Administrative Procedure Reform Working Group?

Specifically, the Prime Minister's Administrative Procedure Reform Working Group (hereinafter referred to as the Working Group for short), consists of the following members:

(1) Team leader: Deputy Prime Minister Tran Luu Quang.

(2) Vice-Chairman:

- Minister, Chairman of Government Office - Standing Deputy Group;

- Minister of Interior;

- Minister of Justice;

- The leader of the Ministry of Public Security is the Standing Deputy of the Working Group to implement the Project "Developing the application of data on population, identification, and electronic authentication for national digital transformation in the period of 2022–2025, with a vision to 2030".

(3) The members are leaders of the Ministries of Planning and Investment, Finance, Industry and Trade, Construction, Transport, Natural Resources and Environment, Agriculture and Rural Development, Science and Technology, Labor - Invalids, and Social Affairs, and Director of the Department of Administrative Procedures Control, Office of the Government - Standing Member.

Thus, Deputy Prime Minister Tran Luu Quang will be the Head of the Working Group on Administrative Procedure Reform.

The Administrative Procedures Reform Working Group is an interdisciplinary coordination organization, performing the function of helping the Prime Minister direct and urge ministries, branches, and localities to implement the objectives, tasks, and solutions on administrative procedure reform, strengthening administrative discipline, and improving policy response capacity.

2. Tasks and powers of the Administrative Procedure Reform Working Group in Vietnam

2.1. Tasks of the Working Group

The administrative procedure reform working group has the following tasks:

- Help the Prime Minister direct and urge the implementation of objectives, tasks, and solutions on administrative procedure reform in ministries, branches, and localities according to documents, programs, plans, and schemes promulgated by the Government and the Prime Minister.

- Timely grasp and assist the Prime Minister in directing the handling of reports and recommendations of individuals, organizations, and the Prime Minister's Advisory Council on Administrative Procedure Reform about obstacles and difficulties for enterprises and people in terms of mechanisms, policies, and administrative procedures that are barriers to production and business activities of enterprises and people's lives (including regulations to be promulgated in the project, draft legal documents);

Periodically or irregularly, work with the Administrative Procedure Reform Advisory Council of the Prime Minister and the business community, related individuals, and organizations to listen, identify difficulties and problems, and promptly direct the solution.

- Help the Prime Minister direct the strengthening of administrative discipline and improve the policy response capacity of ministries, branches, and localities.

- Research and propose to the Prime Minister initiatives and solutions to promote administrative procedure reform, strengthen administrative discipline, and improve policy response capacity.

- Perform other tasks assigned by the Prime Minister.

2.2. Powers of the Working Group

The Administrative Procedures Reform Working Group has the following powers:

- Invite leaders of ministries, branches, localities, the Prime Minister's Advisory Council on Administrative Procedure Reform, relevant individuals, and organizations to work, remove difficulties and obstacles in mechanisms, policies, and administrative procedures that are barriers to the production and business activities of enterprises and people's lives.

- Organize working groups, urge and promote the implementation of tasks and solutions on reforming administrative procedures, strengthening administrative discipline, and policy responses of ministries, branches, and localities.

- Request ministries, branches, and localities to report, provide information, coordinate implementation, and completely solve difficulties and problems on administrative mechanisms, policies, and procedures within the scope and competence of ministries, branches, and localities.

- Other powers assigned by the Prime Minister of Vietnam.
