Who Is Entitled to the Initial Allowance of VND 14.9 Million When Working in Extremely Disadvantaged Areas?

According to the new regulations in Decree 76/2019/ND-CP, individuals working in areas with extremely difficult socio-economic conditions (extremely difficult areas) are entitled to an initial allowance equivalent to 10 months of the statutory pay rate without the requirement of a service period as stipulated in the current Decree 116/2010/ND-CP.

Initial allowance equivalent to 10 months statutory pay rate, corresponding to VND 14.9 million (applied once for the entire tenure) for personnel working in extremely difficult areas as stipulated in Article 2 of Decree 76/2019/ND-CP. To be specific:

Article 2. Applicable Subjects

Officials and public employees, workers in the agencies, organizations, units of the Communist Party, the State, socio-political organizations from central to communal level (hereinafter referred to as commune level) and those receiving salaries in armed forces (including those who are mobilized, seconded, transferred, and regardless of whether they are local people or from other places) who have been classified according to the salary table issued by the competent authority of the Communist Party and the State, working or coming to work in areas with extremely difficult socio-economic conditions, include:

1. Officials and public employees (including probationary employees) in the agencies, organizations, public service providers of the Communist Party, the State, socio-political organizations from central to communal level;

2. Workers under the labor contract policies in the agencies, units of the Communist Party, the State, socio-political organizations as stipulated in Decree No. 68/2000/ND-CP dated November 17, 2000, of the Government of Vietnam on the implementation of labor contract policies for a number of types of work in state administrative agencies, public service providers and Decree No. 161/2018/ND-CP dated November 29, 2018, of the Government of Vietnam amending, supplementing a number of regulations on recruitment of officials and public employees, promotion of officials, upgrading of public employees and implementation of labor contract policies for a number of types of work in state administrative agencies, public service providers;

3. Officers, professional soldiers, defense workers, public employees, contract workers receiving salaries from the state budget under the Vietnam People's Army;

4. Officers, non-commissioned officers receiving salaries, workers in police units and contract workers receiving salaries from the state budget under the People's Police;

5. Workers in cryptographic organizations;

6. Workers within the staffing quota in associations supported by the state budget as stipulated in Decree No. 45/2010/ND-CP dated April 21, 2010, of the Government of Vietnam on the organization, operation, and management of associations and Decree No. 33/2012/ND-CP dated April 13, 2012, of the Government of Vietnam amending, supplementing a number of provisions of Decree No. 45/2010/ND-CP dated April 21, 2010, of the Government of Vietnam on the organization, operation, and management of associations.

Therefore, all the subjects stipulated above are entitled to the allowance of VND 14.9 million when first taking up their post at the agency, organization, unit in areas with extremely difficult socio-economic conditions.

These extremely difficult areas are determined according to Decree 76/2019/ND-CP and consist of the following areas:

2. Areas with extremely difficult socio-economic conditions specified in Clause 1 of this Article, including:

a) Truong Sa Island, Hoang Sa Island, DK1;

b) Communes in category III in ethnic minority and mountainous areas, particularly difficult island communes as per the Decision of the Prime Minister of the Government of Vietnam;

c) Villages, hamlets, neighborhoods, hamlets, clusters, and similar units (collectively called hamlets) in particularly difficult circumstances as per the Decision of the Prime Minister of the Government of Vietnam.
