Unsealing evidence involves removing the sealing paper and opening the packaging or unsealing the evidence for items that are packaged or sealed; removing the sealing paper for items that are not packaged, not sealed, or cannot be moved.
Participants involved in unsealing exhibits as stipulated in Clause 2 Article 7 of Decree 127/2017/ND-CP, include:
- Related individuals; representatives of agencies or organizations with rights, obligations, and responsibilities related to the sealed exhibits (if any);- Defense counsel (if deemed necessary);- Representatives of the commune-level government (commune, ward, commune-level town) where the unsealing of the exhibits takes place (in necessary cases);- Representatives of the agency managing the sealed exhibits in cases where the exhibits are preserved at specialized agencies.
Additionally, the participants involved in sealing exhibits are specifically defined, including:
- Witnesses or representatives of the commune-level government (commune, ward, commune-level town) where the sealing of the exhibits takes place;- Related individuals; representatives of agencies or organizations with rights, obligations, and responsibilities related to the sealed exhibits (if any);- Defense counsel (if any).
