Who Has the Authority to Resolve Military Discharges?

Circular 279/2017/TT-BQP has been issued by the Ministry of National Defense to replace Circular 11/2012/TT-BQP regulating the discharge of non-commissioned officers and soldiers serving in active duty in the People's Army.

According to the new regulations, depending on specific cases, the authority to resolve discharge will be held by different individuals, specifically:

- The Minister of National Defense decides the time and number of non-commissioned officers and soldiers discharged annually.- The regimental commander and equivalent decide the discharge for non-commissioned officers and soldiers under their command.- The divisional commander and equivalent or higher review and approve cases of non-commissioned officers and soldiers discharged ahead of the term.- Within 12 months from the date of issuance of the decision discharging non-commissioned officers and soldiers to the locality, if the individual is received for employment at a State agency, organization, or economic establishment of different economic sectors and wishes to complete the procedures for transfer to the place of employment, the head of the district-level Military Command will review and resolve.
