Recently, the Government of Vietnam issued Decree 165/2017/ND-CP on the regulations for managing and using property at the Communist Party of Vietnam agencies.
Who has the authority to decide property procurement at Communist Party Agencies in Vietnam? (Illustrative photo)
Article 13 of Decree 165/2017/ND-CP stipulates that the procurement of office buildings and other property applies in cases where the Communist Party's agency does not yet have property, lacks property compared to standards, norms, or the property currently available under standards and norms are eligible for liquidation but no property are available for allocation and do not fall under conditions for leasing or cost allocation for property use in Vietnam. Therefore, the authority to decide on property procurement is as follows:
- The Chief of the Central Office of the Communist Party decides or delegates the authority to decide on the procurement of property from the state budget allocated for activities at the Communist Party’s central agencies;
- The competent level as per regulations on managing and using the central reserve fund of the Communist Party’s budget decides or delegates the authority to decide on the procurement of property from the central reserve fund of the Communist Party’s budget for activities at the Communist Party’s central agencies;
- The Standing Committee of the Provincial Party Committee decides or delegates the authority to decide on the procurement of property from the state budget allocated and the Communist Party’s budget reserve fund for activities at the Communist Party’s agencies, which are subordinate accounting units under the Provincial Party Committee’s Office;
- The Standing Committee of the District Party Committee decides on the procurement of property from the Communist Party’s budget reserve fund for activities at the Communist Party’s agencies, which are such subordinate accounting units under the district-level state budget;
- As per the decentralization of the Provincial People’s Council for the procurement of property from the state budget for activities of the District Party Committee’s Office, which are subordinate accounting units under the district-level state budget.
