On October 28, 2024, the Government of Vietnam promulgated Decree 141/2024/ND-CP providing guidance on the Law on Prevention and Control of Human Immunodeficiency Virus/Acquired Immune Deficiency Syndrome (HIV/AIDS).
According to Article 29 of Decree 141/2024/ND-CP, the subjects registering to participate in opioid addiction treatment with substitute medication include:
- Individuals addicted to opioids who voluntarily participate in opioid addiction treatment with substitute medication and commit to adhering to the opioid addiction treatment with substitute medication.
For individuals addicted to opioids aged from 12 to under 18, registration to participate in opioid addiction treatment with substitute medication is only allowed after obtaining written consent from their legal representative.
- Inmates, detainees, students at reformatory schools (hereafter referred to as managed subjects) addicted to opioids before being taken into management in prisons, detention centers, compulsory education facilities, reformatory schools (hereafter referred to as management facilities) who voluntarily participate in opioid addiction treatment with substitute medication and commit to adhering to the opioid addiction treatment with substitute medication.
For individuals addicted to opioids aged from 12 to under 18 (excluding inmates in prisons), registration to participate in opioid addiction treatment with substitute medication is only allowed after obtaining written consent from their legal representative.
Note:
- Individuals currently undergoing treatment who voluntarily terminate opioid addiction treatment with substitute medication.
- Individuals undergoing treatment are terminated from treatment when violating one of the following regulations:
+ Failing to comply with professional procedures for opioid addiction treatment with substitute medication two or more times within six months;
+ Testing positive for opioids two or more times consecutively (except substitute medication) within 12 months after achieving a maintenance dose;
+ Testing positive for other narcotic substances besides opioids;
+ Engaging in acts of infringing upon the property of agencies, organizations; property, health, honor, dignity of citizens or foreigners; violating social order and safety;
+ Voluntarily abstaining from medication for 30 days or more.

Specifically, Article 30 of Decree 141/2024/ND-CP prescribes the registration dossier for participation in opioid addiction treatment with substitute medication as follows:
- For individuals addicted to opioids as prescribed at point c, clause 5, Article 27 of the Law on Drug Prevention and Control:
+ A registration application form for participation in opioid addiction treatment with substitute medication according to Form No. 09 specified in the Appendix issued with Decree 141/2024/ND-CP.
For individuals aged from 12 to under 18, the registration application form for participation must have confirmation from the legal representative of the applicant;
+ A copy of the Decision on Participation in Opioid Addiction Treatment with Substitute Medication issued by the Commune-level People's Committee according to Form No. 10 specified in the Appendix issued with Decree 141/2024/ND-CP.
- For individuals voluntarily registering to participate in opioid addiction treatment with substitute medication:
+ A registration application form for participation in opioid addiction treatment with substitute medication according to Form No. 09 specified in the Appendix issued with Decree 141/2024/ND-CP.
For individuals aged from 12 to under 18, the registration application form must have confirmation from the legal representative of the applicant;
+ The result verification slip for determining drug addiction status according to Form No. 04 specified in the Appendix issued with Decree 141/2024/ND-CP which stipulates medical facilities qualified to determine drug addiction status and the dossier, order, and procedures for determining drug addiction status.
