Which forms shall units use state budget funds to register cash withdrawals with the State Treasury in Vietnam?

Below is a notable regulation issued under Circular 136/2018/TT-BTC amending and supplementing a number of articles of Circular 13/2017/TT-BTC dated February 15, 2017, of the Ministry of Finance of Vietnam regulating the management of cash receipts and disbursements through the State Treasury system.

At present, units using the State Budget that need to withdraw cash in one day (one or multiple payment transactions) exceeding the following prescribed limits must register with the State Treasury of Vietnam where the account is opened at least one working day in advance regarding the amount and time of withdrawal so that the State Treasury of Vietnam can plan and supply cash fully and promptly to the units using the State Budget. To be specific, the cash withdrawal amount that must be registered with the State Treasury of Vietnam is:

- From 200 million VND or more for units using the State Budget conducting transactions with the provincial-level State Treasury of Vietnam.- From 100 million VND or more for units using the State Budget conducting transactions with the district-level State Treasury of Vietnam.

However, Point a, Clause 3, Article 1 of Circular 136/2018/TT-BTC stipulates that units using the State Budget register the cash withdrawal needs for each payment day or for different payment days, but must clearly state the amount and time of cash withdrawal on each payment day. The registration for cash withdrawal with the State Treasury of Vietnam can be done in one of the following forms:

- Registration via telephone with the authorized officer of the State Treasury of Vietnam where the transaction is conducted (Chief Accountant or authorized person for provincial-level State Treasury of Vietnam; Head Accountant or authorized person for district-level State Treasury of Vietnam).

- Registration through the e-public service portal of the State Treasury of Vietnam (in case the State Treasury of Vietnam has deployed the utility for cash withdrawal registration through e-public service).

- Registration in writing with the State Treasury of Vietnam (according to Form 01 issued with Circular 13/2017/TT-BTC).

At the end of the day, the State Treasury of Vietnam officer receiving the cash withdrawal registration from units shall consolidate and report to the Director of the State Treasury of Vietnam or the authorized person for approval; simultaneously, notify the commercial bank where the State Treasury of Vietnam opens an account of the projected amount and time of cash withdrawals at the bank.

Notably, State Treasury of Vietnam units must keep a log to monitor the cash withdrawal registration of units using the State Budget according to Form 02 issued with Circular 13.

In cases where an unit using the State Budget transacts with a State Treasury of Vietnam that has a payment account opened at a commercial bank and needs to register for same-day cash withdrawal at the commercial bank for withdrawals exceeding the limit in one day (one or multiple payment transactions) or for transactions not required to withdraw cash at the commercial bank but the unit needs to withdraw cash at the commercial bank, after controlling State Treasury of Vietnam expenditure and cash payment according to the prescribed policies, the State Treasury of Vietnam shall transfer the cash withdrawal documents electronically to the commercial bank where the State Treasury of Vietnam opens an account for the unit using the State Budget to withdraw cash at the commercial bank following the procedures prescribed in Article 8 of Circular 13/2017/TT-BTC.
