Recently, Decree 24/2014/ND-CP was unanimously issued by the Government of Vietnam, regulating the organization of specialized agencies under the Provincial People's Committees and centrally-governed cities.
According to current regulations, the Department of Foreign Affairs advises and assists the Provincial People's Committee in state management concerning: foreign affairs and national border territory affairs (for provinces with border lines).
To be specific, Decree 24/2014/ND-CP stipulates that the Department of Foreign Affairs shall be established when meeting the following criteria:
- Having a land border with an international or national border gate;- For provinces without a land border, the following conditions must be met:
- Having Industrial Zones, Export Processing Zones, High-Tech Zones, Open Economic Zones, or Border Gate Economic Zones established by decision of the Prime Minister of the Government of Vietnam;- Having a national tourist area or cultural heritage recognized by UNESCO.
Also according to Decree 24, provinces not meeting the criteria to establish a Department of Foreign Affairs shall establish a Foreign Affairs Office under the Provincial People's Committee Office. The Foreign Affairs Office is directly under the command of the Provincial People's Committee. The Provincial People's Committee Office ensures the material and administrative facilities for the operation of the Foreign Affairs Office.
