Which Cases Must Be Recorded in the Adoption Register?

Decree No. 24/2019/ND-CP has been signed and promulgated by the Government of Vietnam to amend and supplement Decree No. 19/2011/ND-CP, specifying the detailed implementation of certain provisions of the Law on Adoption.

According to the new regulations, the adoption between Vietnamese citizens or between Vietnamese citizens and foreign nationals that has been resolved by the competent authorities of a foreign country shall be recorded in the Adoption Registration Book in the following cases:

- The adoption has been resolved according to the provisions of an international treaty to which both Vietnam and the country resolving the adoption are members;- The adoption has been resolved according to the legal provisions of the foreign country, except in cases where it violates the fundamental principles of the law of the Socialist Republic of Vietnam.

Also according to Decree 24/2019/ND-CP, the authority and procedures for recording in the Adoption Registration Book shall be implemented according to the provisions of the law on civil status.
