Which authorities have the power to decide on recall of the property at the Communist Party of Vietnam's agencies?

On December 31, 2017, the Government of Vietnam promulgated Decree 165/2017/ND-CP on the regulations for the management and use of property at the Communist Party of Vietnam's agencies.

Which authorities have the power to decide on the recall of the property at the Communist Party of Vietnam's agencies? (Illustrative image)

Clause 2 Article 24 Decree 165/2017/ND-CP stipulates that the following authorities have the power to decide on the recall of the property at the Communist Party of Vietnam's agencies:

- Chief of the Office of the Central Committee of the Communist Party of Vietnam decides or delegates the power to decide on the recall of property at the Communist Party of Vietnam's central-level agencies;

- The standing committee of the district-level CPV committee decides or delegates the power to decide on the recall of property at the Communist Party of Vietnam's agencies which are subordinate budget units under the office of the provincial CPV committee;

- The standing committee of the district-level CPV committee decides on the recall of property formed from the Communist Party's reserve budget serving activities at the Communist Party of Vietnam's agencies which are budget units under the district-level state budget;

- Agencies and individuals with power, as delegated by the Provincial People's Council, decide on the recall of property allocated by the State in kind and property invested, constructed, and procured from the state budget at the office of the district-level CPV committee which is a subordinate budget unit under the district-level state budget;

- The power to recall land use rights allocated for investment projects to construct headquarters whose project progress is delayed resulting in recall shall follow legal regulations on land.
