Which Agency Receives Wildlife Voluntarily Surrendered by Organizations or Individuals?

The Minister of Agriculture and Rural Development issues Circular 29/2019/TT-BNNPTNT Regulations on handling wildlife that is material evidence; wildlife voluntarily surrendered to the State by organizations or individuals.

Article 7 of Circular 29/2019/TT-BNNPTNT stipulates that the following agencies are responsible for receiving, nurturing, and preserving wild animals voluntarily handed over by organizations and individuals to the state:

- National parks under the General Department of Forestry.- State-managed wild animal rescue centers, state-managed zoos, and special-use forest management boards not under the General Department of Forestry that have wild animal rescue facilities.- District-level Forest Protection Agencies, provincial-level Forest Protection Agencies.

The receiving agency or unit is responsible for nurturing and preserving voluntarily handed-over wild animals during the period when procedures for establishing state ownership and approving the handling plan for assets as voluntarily handed-over wild animals to the state are carried out.

In cases where the receiving Forest Protection Agency lacks the conditions for nurturing and preserving, they shall transfer the voluntarily handed-over wild animals to a facility capable of nurturing and preserving them. The transfer must be documented with a wild animal transfer and receipt record according to Form No. 01 issued with this Circular.

Additionally, Circular 29/2019/TT-BNNPTNT stipulates that the receiving agency or unit must prepare a wild animal transfer and receipt record according to Form No. 01 issued with this Circular. In the case where national parks under the General Department of Forestry receive voluntarily handed-over wild animals from the state, the receiving unit shall carry out procedures for establishing state ownership, prepare, and submit the handling plan for assets as voluntarily handed-over wild animals to the state for approval by the General Director of the General Department of Forestry, in accordance with legal provisions on the management and use of public assets.

For cases where district-level Forest Protection Agencies or state-managed wild animal rescue centers, state-managed zoos, or special-use forest management boards not under the General Department of Forestry that have wild animal rescue facilities receive voluntarily handed-over wild animals from the state that belong to endangered, precious, and rare species lists, they must immediately notify in writing, along with the transfer and receipt record, to the provincial-level Forest Protection Agency to carry out procedures for establishing state ownership, preparing, and approving the handling plan for assets as voluntarily handed-over wild animals to the state in accordance with legal provisions on the management and use of public assets.

In cases where agencies or units defined in Clauses 2 and 3 of Article 7 of this Circular receive voluntarily handed-over wild animals from the state that belong to common species, the receiving agency or unit shall carry out procedures for establishing state ownership, preparing, and approving the handling plan for assets as voluntarily handed-over wild animals to the state in accordance with legal provisions on the management and use of public assets.
