Where to Notarize Documents?

Greetings, Legal Secretary. My name is Nguyen Thi Oanh. Currently, I wish to notarize a housing purchase contract. Where can I carry out this procedure? I look forward to receiving assistance from the Legal Secretary soon.

Thu Ky Luat would like to respond to your inquiry as follows:

Notarization is an activity that occurs very frequently in daily life. It is understood as the certification by a notary public of the authenticity and legality of a contract or other written transactions as required by law to be notarized or as voluntarily requested by individuals or organizations.

According to the law, there are two forms of notarial practice organizations. This means there are two places to notarize contracts and written transactions. To be specific:

  1. Notary Office.- It can only be newly established in areas where the conditions for developing Notarial Offices are not available.- It is established by a decision of the provincial People's Committee.- The name of the Notary Office includes the phrase "Notary Office" along with the establishment number and the name of the province or centrally-run city where the Notary Office is established.
  2. Notarial Office.- It is organized and operates under the provisions of the Law on Notarization 2014 and other relevant legal documents for the type of partnership company.- It must have at least 02 partner notaries and no capital-contributing members.- The name of the Notarial Office must include the phrase "Notarial Office" along with the name of the Head of Office or the name of another partner notary as agreed upon by the partner notaries. The name must not duplicate or cause confusion with the names of other notarial practice organizations, and must not violate historical, cultural, ethical traditions, and customs.- The Notarial Office can commence notarial activities from the day the Department of Justice issues an operation registration certificate.

Thus, according to the above regulations, you can notarize at either the Notary Office or the legally established and regulated Notarial Office.
