When shall the Vietnam Register revoke and terminate the type approval certificate of transport construction machinery?

Circular No. 89/2015/TT-BGTVT on technical safety quality and environmental protection inspection of transport construction machinery was issued on December 31, 2015 by the Ministry of Transport of Vietnam. One of the notable contents of this Circular is the regulation on revocation and termination of a type approval certificate of transport construction machinery (TCM).

According to Circular No. 89/2015/TT-BGTVT of the Ministry of Transport of Vietnam, Vietnam Register shall give a written notification of revocation and termination of a type approval certificate in the following cases:

- TCM type no longer meets applicable national technical regulations and/or standards, or there are changes in TCM type resulting in its unconformity to the inspection dossier and the granted type approval certificate but the manufacturer fails to apply for re-inspection in accordance with regulations;

- The CoP assessment report shows that the manufacturer commits serious violations against regulations on quality inspection or use of factory certificate;

- Ending the second suspension period of the type approval certificate but the manufacturer still fails to remedy its violations.
