Dissolution of schools and suspension of educational activities are two new contents compared to the Education Law 2005 as stipulated in the amended Education Law 2009.
Accordingly:
The school will be dissolved in the following cases:
- Serious violations of regulations on school management, organization, and operation;- Expiration of the suspension period of educational activities without rectifying the cause of the suspension;- The objectives and content of activities in the decision to establish or to allow the establishment of the school no longer align with the socio-economic development needs;- Upon the proposal of the organization or individual establishing the school.
The decision to dissolve the school must clearly state the reason for dissolution and measures to ensure the rights of teachers, learners, and laborers in the school. The decision to dissolve the school must be publicly announced in the mass media.
The school shall be suspended from educational activities in the following cases:
- Engaging in fraudulent actions to obtain permission for educational activities;- Failing to ensure any of the conditions specified in Clause 2 of Article 50 of this Law;- The person granting permission for educational activities does not have the authority;- Failing to initiate educational activities within the prescribed period from the date of obtaining permission for educational activities;- Violations of the education law subjected to administrative sanctions at the level requiring suspension;- Other cases as provided by law.
The decision to suspend educational activities for the school must clearly state the reason for suspension, suspension period, and measures to ensure the rights of teachers, learners, and laborers in the school. The decision to suspend educational activities for the school must be publicly announced in the mass media.
After the suspension period, if the cause leading to the suspension is rectified, the authority deciding the suspension shall issue a decision allowing the school to resume educational activities.
