When is the Groundwater Drilling Permit Suspended?

According to the provisions of Circular 40/2014/TT-BTNMT, the suspension of license validity is implemented in the following cases:

- The license is suspended when the license holder violates the provisions specified in the license causing land subsidence, deformation of structures, or serious pollution and depletion of water resources;- The period for suspending the license validity does not exceed three (03) months;- During the period the license is suspended, the license holder is not entitled to any rights related to the license and must take remedial measures and compensate for damages according to legal regulations;- Upon the expiry of the suspension period, if the licensing authority does not issue another decision, the license holder may continue exercising his/her rights and obligations.

Additionally, Circular 40 also stipulates 05 cases for revoking the groundwater drilling practice license as follows:

- The license holder is found to have falsified documents, provided untruthful declarations in the application dossier, or altered the content of the license;- The organization holding the license is dissolved or declared bankrupt by the court;- The license holder violates the suspension decision of the license, recidivates, or repeatedly breaches the provisions of the license;- The license is issued by an unauthorized authority;- The license is issued but the license holder fails to fulfill financial obligations and does not receive the license.
