When Does the Complaint Resolution Officer in the Military Organize a Dialogue?

This is an important item in Circular 218/2013/TT-BQP issued by the Minister of National Defense providing guidance on complaints and complaint resolution within the Armed Forces.

Circular 218/2013/TT-BQP stipulates that the complaint resolving authority must organize a dialogue in the following cases:

- During the first-time complaint resolution process, if the complainant's requirements and the verification results of the complaint contents differ, or the verification results of the complaint contents have different opinions and the complaint is made a second time, the complaint resolving authority must organize a dialogue with the complainant, the complained person, individuals with related rights and interests, and related agencies, organizations, or individuals to clarify the complaint contents, the complainant's requirements, and the complaint resolution direction;- The dialogue must be conducted publicly and democratically according to the provisions of Article 30, Article 39, Law on Complaints.- In case the person with authority to resolve the complaint cannot participate in the dialogue (due to duty execution), they may delegate the Chief Inspector of their level or the Head of the verification team to conduct the dialogue upon issuing the resolution decision.- The dialogue must be documented in writing; the document must clearly state the opinions of the participants, the dialogue results, and must have the signatures or fingerprints of the participants; in case the participants do not sign or fingerprint to confirm, the reasons must be stated clearly.

Thus, the complaint resolving authority organizes a dialogue during the first-time complaint resolution process when the complainant's requirements and the verification results of the complaint contents differ, or the verification results of the complaint contents have different opinions and the complaint is made a second time.
