When do retiring officers holding leadership positions receive salary rank adjustments?

This is a notable provision mentioned in Circular 17/2013/TT-BCA of the Ministry of Public Security guiding the implementation of rank promotion and salary increase for police officers and employees upon retirement.

Case 1: Officers holding the rank of Bureau level and equivalent positions, if promoted to the grade of Colonel (or enjoying the first tier salary of the Colonel rank) for 2/3 of the prescribed period or more, shall be considered for first tier salary increase of the Colonel rank (or second tier salary increase of the Colonel rank). If already enjoying the second tier salary of the Colonel rank (coefficient 8.60), it remains unchanged to implement pension.

Case 2: Officers holding the rank of Department Head and equivalent positions, if promoted to the grade of Colonel (coefficient 8.00) for 2/3 of the period or more or promoted to the grade of Colonel (coefficient 8.10) for 2 years or more, shall be considered for the first tier salary increase of the Colonel rank (coefficient 8.40).

Example 1: Comrade Duong Van K, Department Head of Bureau X, rank of Colonel (coefficient 8.10/2010), retired pending from September 1, 2013. Comrade K is considered for a salary increase from coefficient 8.10 to coefficient 8.40, effective from June 1, 2013.

For officers holding Department Head and equivalent positions who have already enjoyed the first tier salary of the Colonel rank (coefficient 8.40), it remains unchanged to implement pension.

Case 3: Officers holding positions at Division level and equivalent or lower (except for those specified in Clause 2 of this Article), currently having a rank equal to or lower than the highest rank prescribed for the position held:

If currently enjoying the second tier salary of the rank, they are considered for a rank promotion before retirement 6 months in advance.

Example 2: Comrade Le Van C, Deputy Division Head of Bureau V, rank of Senior Lieutenant Colonel (coefficient 8.10/2012), retired pending from October 1, 2013. Comrade C is considered for a rank promotion from Senior Lieutenant Colonel (coefficient 8.10) to Colonel, effective from April 1, 2013.

If currently enjoying the first tier salary of the rank for 2/3 of the period or more, they are considered for a second tier salary increase and a rank promotion.

Example 3: Comrade Hoang Van M, Deputy Division Head of Provincial Police H, rank of Senior Lieutenant Colonel (coefficient 7.70/2009), retired pending from June 1, 2013. Comrade M is considered for a salary increase from coefficient 7.70 to coefficient 8.10 and a rank promotion from Senior Lieutenant Colonel to Colonel, effective from March 1, 2013.

If currently enjoying the first tier salary of the rank for less than 2/3 of the period or having the rank for 2/3 of the period or more, they are considered for a rank promotion.

Example 4: Comrade Do Dinh H, Team Leader, District Police Q, rank of Lieutenant Colonel (coefficient 7.00/2012), retired pending from June 1, 2013. Comrade H is considered for a rank promotion from Lieutenant Colonel (coefficient 7.00) to Senior Lieutenant Colonel, effective from March 1, 2013.

Case 4: Officers holding positions at Division level and equivalent or lower (except for those specified in Clause 2 of this Article), currently having a rank higher than the highest rank of the position held, shall remain unchanged to implement pension.

Specifically, officers who directly participated in combat in battlefields B, C, K before April 30, 1975, or engaged in work before April 30, 1975, who were awarded medals for resisting the U.S. invasion or were war invalids (A category), if upon retirement they had been promoted to a rank higher than the highest rank prescribed for the position held for 2/3 of the period or more, then before receiving the pension for 3 months, they are considered for a first tier salary increase of that rank.

Example 5: Comrade Nguyen Van M (participated in combat in battlefield B before April 30, 1975), Deputy Division Head of Bureau X, rank of Colonel/2010; received a pension from December 1, 2013. Comrade M is considered for a salary increase from coefficient 8.00 to coefficient 8.40, effective from September 1, 2013.
