What type of contract is a visiting lecturer contract in an educational institution in Vietnam?

On October 10, 2011, the Minister of Education and Training issued Circular 44/2011/TT-BGDDT regulating the visiting lecturer policies in educational institutions in Vietnam.

According to Article 7 of Circular 44/2011/TT-BGDDT, the stipulations regarding visiting lecturer contracts in educational institutions are as follows:

1. Visiting Lecturer Contracts for visiting teachers who are officials and public employees in Vietnam:

A visiting lecturer contract is a task-specific contract. The establishment, execution, modification, and termination of the visiting lecturer contract are carried out in accordance with the provisions of Section 7, Chapter XVII of the Civil Code. Employment contracts are not utilized for the visiting lecturer activities of officials and public employees.

The visiting lecturer contract must include a clause in which the visiting teacher commits to ensuring the completion of duties at their current workplace.

2. Visiting Lecturer Contracts for visiting teachers who are not officials and public employees in Vietnam:

- For activities specified in points a, b, c, d of clause 1, Article 2 of the Regulation issued with Circular 44/2011/TT-BGDDT, the visiting lecturer contract is a labor contract as defined by the Labor Code. The establishment, execution, and termination of the visiting lecturer contract, as well as the process for complaints, denunciations, and the resolution of these, are carried out according to labor law provisions.

- For visiting lecturer activities specified in point e, clause 1, Article 2 of the Regulation issued with Circular 44/2011/TT-BGDDT, the visiting lecturer contract is a task-specific contract. The establishment, execution, modification, and termination of the visiting lecturer contract are carried out in accordance with the provisions of Section 7, Chapter XVII of the Civil Code.
