What support is provided for people with meritorious services who settle abroad?

The beneficiaries currently residing abroad shall enjoy the following policies:

1. Subjects stipulated in Clause 1, Article 2, Decree 102/2018/ND-CP:

(a) For living beneficiaries:The support regime is calculated from the (month, year) the beneficiary stops receiving benefits to the (month, year) the competent authority issues a decision to implement the support regime and is calculated according to the following formula:

A = (B - C) x D

Where:

- A is the level of support;- B is the time (month, year) of the support decision;- C is the time (month, year) the beneficiary stopped receiving monthly allowance policies;- D is the level of allowance in the month immediately preceding the month of stopping the policies (converted to the equivalent benefit level at the time of implementing the support policies as stipulated by the Government of Vietnam).

(b) For deceased beneficiaries:Relatives of beneficiaries stipulated in Clause 5, Article 2, Decree 102/2018/ND-CP shall receive support policies calculated from the time (month, year) the policies of monthly allowances stopped to the time (month, year) the beneficiary passed away, according to the following formula:

A = (G - C) x D

Where: G is the time (month, year) the beneficiary passed away.

(c) For biological children or legal adoptive children of martyrs:They shall receive support policies calculated from the time (month, year) the policies of monthly allowances stopped to the month immediately preceding the month of their 18th birthday, according to the following formula:

A = (I - C) x D

Where: I is the time (month, year) immediately preceding the month of their 18th birthday.

(d) Beneficiaries who have received support policies as per (a), upon their death, their relatives stipulated in Clause 5, Article 2, Decree 102/2018/ND-CP:Shall receive support policies for the period calculated from the month immediately following the month and year in which the previous support policies decision was made to the time (month, year) the beneficiary passed away. The formula is as follows:

A = (G - K) x D

Where: K is the month and year immediately following the month and year of the previous support policies decision.

1. Subjects stipulated in Clauses 2, 3, and 4, Article 2, Decree 102/2018/ND-CP:

(a) Shall receive support policies, the level of support calculated based on the actual number of years participating in the revolution, war to protect the nation, international duties, and civil service in fire lines (collectively referred to as working time). Specifically as follows:

- Up to 2 years of service, support level: 4,000,000 VND;- Over 2 years, from the 3rd year onwards, an additional 1,500,000 VND per year;- For cases where the beneficiary passed away before the effective date of this Decree, their relatives stipulated in Clause 5, Article 2, Decree 102/2018/ND-CP shall receive a one-time support of 6,000,000 VND.

(b) Time for calculating the benefit policies:

- The beneficiaries being soldiers, people's public security officers, and persons working in cipher organizations receiving salaries equivalent to soldiers is the total actual working time in the army, police, and cipher (excluding the time of international labor cooperation). The remaining subjects are the direct combat and service periods within the timeframe and locations stipulated in Clauses 2, 3, and 4, Article 2, Decree 102/2018/ND-CP;- In case a person has periods of participating in the revolution, war to protect the nation, fulfilling international duties, and participating in civil service fire lines belonging to different groups of subjects stipulated in Clauses 2, 3, and 4, Article 2, Decree 102/2018/ND-CP or different periods, they shall be aggregated. Excluding the time already considered for one-time or monthly allowance policies according to the Prime Minister's Decisions and Government's Decrees (Appendix I attached to Decree 102/2018/ND-CP);- The one-time support policy calculation term for fractional months: if having at least 06 months, it is considered as one year; less than 06 months, it is considered as 1/2 year.

1. Beneficiaries stipulated in Clause 1, who also belong to the groups stipulated in Clauses 2, 3, and 4, Article 2, Decree 102/2018/ND-CP shall enjoy both the support policies stipulated in Section 1 and Section 2.

Decree 102/2018/ND-CP takes effect from September 05, 2018.
