What powers does the Property Valuation Council in Criminal Proceedings have?

This is an important content in Circular 30/2020/TT-BTC guiding certain provisions of Decree 30/2018/ND-CP dated March 07, 2018 of the Government of Vietnam detailing the establishment and operation of the Property Valuation Council; the order and procedures for property valuation in criminal proceedings and Decree 97/2019/ND-CP amending and supplementing certain provisions of Decree 30/2018/ND-CP dated March 07, 2018 of the Government of Vietnam detailing the establishment and operation of the Property Valuation Council; the order and procedures for property valuation in criminal proceedings.

The chairman of the Valuation Council and the members of the Council have rights and obligations as stipulated in Article 11 and Article 12 of Decree 30/2018/ND-CP. Based on the nature of the asset valuation case, the Chairman of the Valuation Council decides on the number of valuation sessions and assigns tasks to the members of the Council and the Assisting Team of the Valuation Council (hereinafter referred to as the Assisting Team) (if any) to prepare explanatory reports, technical explanations for the Valuation Council sessions, and other tasks of the Valuation Council.

In addition, the rights and obligations of the Assisting Team of the Valuation Council are stipulated in Circular 30/2020/TT-BTC as follows:

- Prepare explanatory reports, technical explanations for the Valuation Council sessions, and other related tasks of the Valuation Council as assigned.- Develop the program and content of the sessions as assigned by the Chairman of the Valuation Council. Perform office work, material conditions, and stationery to serve the Valuation Council sessions and other works related to the Valuation Council sessions.- The Head of the Assisting Team is responsible to the Head of the competent authority establishing the Valuation Council and the Valuation Council; assign tasks to the members of the Assisting Team; and oversee the general activities of the Assisting Team.- The members of the Assisting Team perform the tasks assigned by the Head of the Assisting Team and are accountable to the Head of the Assisting Team.
